By the way, by those definitions if both parties are drunk neither can consent so who raped who? Did they rape each other and they should both be prosecuted by a 3rd party?

Yes, technically that is true. However, two things have to take place. First, the police officer has to believe that a crime was in fact committed and then go forward with the charges. Secondly, if the charges are pressed that doesn’t mean that after a careful review of all of the evidence that a conviction would be forthcoming.
