To clarify ^^, that is a BS move. As per Harold Ford (a lawyer) of Fox (the Democrat “voice”), you can’t throw spaghetti at the wall with multiple charges, then decide after all the evidence has been presented to ignore the spaghetti that didn’t stick.
If Penny gets convicted of the lesser charge, that judge’s crappy decision/instruction is grounds for an appeal/reversal.

Correct me if I’m wrong, as I’m not an attorney but, by dismissing the more serious charge it could make conviction on the lesser charge an easier pill to swallow for the jury? Is that the thinking? Again, I could be wrong, but is this the plan all along from the DA? Meaning, over charge him knowing he won’t get convicted on the more serious ones while increasing the chances he could get convicted on one of the other charges? It sounds like gaming the system.

But the jury is hung based on the summation of what was presented. The judge/DA can’t just change the “menu” because the jury is hung, that’s BS; only happens in NYC. Smacks of bailing out the DA, because if they were to waste more taxpayer dollars trying this case again, there’s no way that flies imo.
Ok. I get it now. It does seem like asking the jury to do the prosecution’s job. Here’s our evidence, you figure out what he’s guilty of. It’s like conviction by multiple choice and the judge just removed a choice. Hopefully they choose none of the above.

Like, maybe there’s a call about two kids shooting at each other in the middle of the street around midnight…then one of those kids runs off, collapses and dies, and family wants to gripe later? Because who doesn’t let their 14 or 15 year olds run the streets by themselves at all hours?
