I thought for a minute that my computer was glitching. I already had up a tab for revisor (the site you linked). I was looking at the statutes for 2nd degree manslaughter (trying to understand the charges for the police killing in Brooklyn Center). The pages have the same heading and what not.

I don’t know. Look at the one from Brooklyn Center. Waving the gun all over the place, dropping it on the ground after shooting the guy, and lets not forget: mistaking it for a taser. Now based on my research into the charges brought against the officer, I don’t believe it will make it to court (the prosecution will drop it once the situation cools). In MN, for 2nd degree manslaughter one needs to do negligent things as well as consciously acknowledge the dangerous act before doing so. Basically it has to have recklessness involved too.
So if shooting targets in your back yard, and a stray bullet hits your neighbor, that would be negligent and reckless (and this would be 2nd degree manslaughter in MN). Dropping a gun that results in a discharge that kills someone wouldn’t meet the legal definition. If you were juggling guns and had a discharge that killed someone that again would meet the definition.
Pretty embarrassing thing for that officer though (in regards to the video you posted).
That is the exact thing I was looking at. I really doubt the prosecutor plans on bringing this to court. The arrest was to quell the public. It will be dropped when people forget about it. Maybe I am missing something here though as I am not a lawyer?
