I stated early in this thread I believe legal prosecution should rest on proof of guilt.

My personal opinion about this particular case is that the guy probably is a creeper. This is just my opinion though I believe he is entitled to innocence until proven guilty.

I don’t know what thread you’re talking about but I remember the news flurry about that. My opinion was that Zimmerman was attacked. Had I felt otherwise, I would’ve said so though I would’ve supported his right to innocence until proven guilty either way.

I’m not going to comment too much on the possibility that this is a scam on the part of the woman – simply because I have no way of knowing beyond speculation. Scams happen all the time…but then again, creepy shit happens all the time, too.

So, let’s just momentarily go with the assumption that it happened more or less as reported, AND it can be proven in court.

First, the bodily fluids issue – It should be noted that spitting on someone would be a misdemeanor form of assault or battery (definitions vary by state) just about anywhere, if not downright everywhere, in the United States.

Feel free to test this hypothesis – intentionally spit on someone right in front of a police officer.

Repeat this test in all 50 states and the District of Columbia. Report your findings.

If you still don’t think it’s that big a deal, imagine if it were some random dude’s blood.

And this is where we get into the ‘emotional distress’ aspect. As a potential disease vector, semen is something to be concerned about – anyone sane would get various pathogen tests for months or even a year after exposure, and possibly get a court order to get the guy in question tested as well. Many folks would be at least mildly concerned about their future health status at least until the preliminary tests came through, and plenty of others would still have some doubts about things even after the later tests.

As to whether or not Gold’s Gym will be held accountable…seriously? Is this even a question? In America, employees are held as representatives of the company while working for the company on company property. Both the individual and the company will be held to certain standards.

In other words, if I work at Wendy’s, and I poop in your take-out Chili cup, Wendy’s sure as hell is going to be held at least a little bit liable, because I am a representative of said corporation. I’m not saying that it’s 100% right, or that it’s a just decision in all cases, because this leaves a lot of holes open for people to sabotage a company…but it is how things work in the United States.

I doubt it’s going to play out to millions of dollars, but if this case can be proven in court, there’s going to be some pay-out.

I just hope it actually can be proven and it won’t be settled for some hush money, that’ll just encourage more scammers in the future.

So how much would you expect the woman to receive as compensation for her emotional distress? Emily stated earlier that she expected the woman to receive a $200-$300K settlement (from the gym, no less). Is that amount reasonable, do you think?
