San Diego County District Attorney Bonnie Dumanis has filed a lawsuit of Schwarzen-failure’s sentence commutation because “he was helping out a friend.” The lawsuit claims to have violated the victim’s family’s civil rights according to Marsy’s Law. He did not follow protocol, nor did he notify appropriate people, nor was the reasoning behind the commutation moral or just. The lawsuit seeks to reinstate the original 16 yr sentence of the dirtbag boy who stabbed the victim.

So to recap…

Arnold’s legacy has been defined by

The way the “law” is worded, how the fuck were victims treated before? That’s a serious question, not rhetorical. I am asking for a response because I’m unclear how a victim in these cases is normally treated.

The “respect and dignity” IS ad copy; it’s meant to evoke an emotional response, to get people to side with Marsy’s Law. Do you disagree? Sounded like you think Marsy’s Law IS ridiculous, which would mean that we are on the same goddamn page.

There is nothing out of usual in the wording. This just makes me think you are ignorant of The Constitution. Have you never read any laws or writs or amendments?

The verbiage in the statement is ABSOLUTELY CORRECT as it is to the presiding judge of the time to determine the infraction. Does that help to explain the words of which you took such offense?

In any case, what isn’t included in a law is not subject to that law including any such esoteric or idealized traits such as dignity and respect.

The point is that offenders should not be released as soon as they have historically been released, because it is an “insult” to the victim. So, parole denials can be extended far longer than they traditionally have been, and that this is the “respect and dignity” toward the victims on the part of the justice system. That’s all I got from reading about it.

Yes, I had read about the case and yes, I agree that it is ridiculous, but why not just strip governors of the ability to commute sentences? Other states have done it. Perhaps you identify with it more closely because of where you are, and that’s fine, I would have done the same if it happened here. I thought it was ridiculous that the Oakland cop Mesherle shot that kid in the back when he was face down.
