Back on-topic, I can’t say I’m surprised or happy about it, but my prediction was correct. I hope Penny’s lawyers can get a change of venue or otherwise ensure he gets a fair trial.

I predict another Chau-trial, similar to the one where Derek Chauvin was somehow convicted of second degree murder, among other charges. I predict another state-sponsored, media-fueled legal farce replete with manufactured racial narratives and plenty of lying Democrats. I’m not happy to make those predictions, either.

I think the number of outraged protesters is overblown. I wouldn’t be surprised if most New Yorkers are sympathetic towards Penny because they are all fed up with being forced to accommodate criminals and psychos. It’s one reason why that jackass was elected mayor.

Bernard Goetz was acquitted of any homicide charge notwithstanding that he used a gun. I have some hope for Penny.

New York Penal Law 125.15:
A person is guilty of manslaughter in the second degree when:

  1. He recklessly causes the death of another person; or

2. Repealed by L.2019, c. 1, § 8, eff. Jan. 22, 2019.

  1. He intentionally causes or aids another person to commit suicide.

Manslaughter in the second degree is a class C felony.

I’m not a New York lawyer, but as best as I can tell, the potential sentence is anywhere from 1 to 15 years.

Liked for linking the law. This is similar to the Chauvin trial for it’s inevitable Chau-trial aspects, but in my layperson opinion the 2nd Degree Manslaughter charge isn’t nearly as flimsy as Chauvin’s 2nd Degree Murder charge. I’ll be following this case closely.

I suppose it gets back to the first question you asked in this thread.

I’d like to see the whole lead-up and whatever footage is available. It’s tough to make a judgement between reasonable and reckless without knowing all that is available to know.

I am still leaning towards a reasonable man acting in a reasonable way without fully understanding what he was doing. I’d also like to know if Neely was intoxicated.

Who knows?

What we definitely will not get to witness is any sort of policy shift that results in fewer people like Jordan Neely tragically left to fend for themselves on the streets, in the parks and among normal commuters on buses and subways.

A so called witness, quoted in the Washington Post article above, claimed Penny removed his jacket and aggressively threw it down before confronting Neely. From the still images I’ve seen, Penny is wearing a jacket. The press really doesn’t do their due diligence anymore.

In the video, while he is holding Neely, he appears to not only be wearing a jacket but a backpack.

It would definitely make sense to throw down his jacket, then put it back on, and add a backpack, before confronting the guy.

I’m leaning towards: Yet another white supremacist killing an innocent Black man for being Black. You wonder whether the Black victim was intoxicated because you are a product of the white supremacist society to which you belong. I wonder why white supremacists are so stupid that they frequently murder Black men in plain view of the public and cameras…at least, try to hide your crimes, guys.

Bears do this right before they attack.

In fact, I recently saw a documentary called “Cocaine Bear” that was a real eye opening look into their behaviors.

Hint- they’ve strayed a long way from the path that great bears like Yogi, Fozzy, and Winney laid out for them.
