If an American citizen who owns a gun legally in one state, is caught in New Jersey with that gun, I doubt this defense would work.
I don’t believe so. In States that allow private sales, I believe the only prohibition is knowingly selling to someone who is prohibited from owning a firearm. ID is usually a good thing to get…since there is usually a record of someone having acquired that firearm at some point, and a seller likely doesn’t want to be the last person associated(with no knowledge of whom he sold to) with a firearm left at a murder scene or something.
