I think a big part of the problem is that the accusation is allowed to do so much damage without any trial or proof. The duke lacrosse players had a lot of harm done to their lives even though there was no corroborating evidence and even though the victim did not have credible detail. In fact, the only Duke lacrosse player she picked out of a lineup had an airtight alibi.
An impartial and professional investigation would have quickly cleared them with little inconvenience to them personally. But the bias and incompetence of our justice system allowed the accusation to do grave irreparable harm to them. Our innate sense of justice wants someone to pay for that unjust harm. We should aim our ire at a justice system that has lost its principles and been overtaken by hacks. Crazy and vindictive people will always exist and perhaps the justice system can sometimes punish them. But the first focus needs to be not punishing the innocent. Ultimately, that is the biggest failure of our justice system in the Duke lacrosse case.
