The Supreme Court Fight is On. The Divide Worsens

As an aside, for any interested in international differences, Ireland can have supreme court decisions on the constitutionality of legislation WITHOUT any published dissent, provided that a reference is made by the President to the SC under an Article 26 reference. Once this is done no constitutional challenge can ever be made to the legislation again.

That summary at the end said it all.

My thoughts are that if Kavanaugh is confirmed…the worst thing the DEMS could have done was wring out any sense of impartiality that Kavanaugh may (or may not) have had.

With that said, however…people respond in unexpected ways to difficult experiences in their Lives. Who really knows what effect all of this will have on Kavanaugh and his eventual decisions.

Again…we’ll see.

Don’t you think that the Anita Hill episode kind of “muted” Clarence Thomas…or is that just him?

(Note: I use the term “muted” in terms of just “being there” with little public appearance or opinion).

That’s a very hard question to answer. I don’t think most judges on the SC pursue public appearance in the way that RBG or Scalia do/did. Would he have been a more public personality? Maybe.

His voting record, however, is not that of a man cowed, as he is easily the most conservative justice on the court, and he isn’t afraid to publish lengthy decisions attesting to that fact.

IF confirmed…maybe what we will see from Kavanaugh…especially after this experience?

Well, I haven’t read his existing body of work, but maybe? It’s a lifetime appointment, maybe Thomas and himself pitch up a tent on that side of the voting aisle, and never depart. Maybe he moves to the centre and becomes the swing vote.

Lord knows, he’d a motive for very closely scrutinising any legislation proposed by Senators Blumenthal, Feinstein, Harris, or Booker. If confirmed, he’d have the means and opportunity.

Come on. Nobody on that court is impartial politically. Why do you think this whole thing is happening in the first place? If the nominee was a stanch democrat he could have walked in the Senate wearing a fur coat, smoking a cigar, drinking scotch, with a playboy bunny on either arm wearing bikinis and the democrats would have rubber stamped it without a second glance.
Nobody really cares about this Ford woman. She’s a political football. A last ditch effort, a ‘hail mary’ to keep him from confirmation. Sadly, it worked enough to delay it.
I wish the Rep’s had the balls to have none of it. The accusation wasn’t credible, still isn’t credible, has no evidence, what so ever.
All I would have asked is, “Is there any evidence?”
“No”
“Next!”
