Yes indeed the system works once again. Seperation of Powers saves the day for muscle heads, fat people, and for people in general to make up their own minds on what supplements to take. Have you read the opinion? I wonder what the basis of the ruling was – I can’t tell from the article whether it was process-based or not. THe language of the article suggests the judge ruled the agency hadn’t applied the proper level of scrutiny for foods, and had applied the drug level, but I never trust AP stories on court cases.
From what I’ve read, it looks like the judge overturned the ban as not complying with Congress’ specific legislation on FDA treatment of supplements (that is, that the burden of proof is on the FDA, and not the supplement companies).
But all that means is that Congress can go ahead and reduce the burden of proof, making things even worse.
