Shot at on the Golf Course

You need to sue this place for small claims. Jut ask them for like $10,000 or something. Have your friend’s lawyer get all the medical documentation and take written statements from all the medical personnel who treated your friend. If his lawyer applies the pressure, you can probably get an out of court settlement.

10 grand isn’t small claims. However, I do agree that he should of asked the golf course for some green to keep their mouths quiet about it. The kids are a known nuisance and they haven’t done anything to correct it. Start throwing around some legal terms like negligence and you never know what you might get…course they could just threaten you back.

My main question is if you are going to go through the hassle of dressing up in goofy expensive clothes, buy clubs, etc. Why wouldn’t you cough up the extra couple of bucks to go to a nice golf course?

Some pellet type guns have co2 cartridges. Some also can be fired in bursts or fully auto. I used to have a an m4a1 plastic pellet gun that could fire auto and burst.

I’d rather just cut my losses on the whole deal, I personally wasn’t injured but will stand beside my friend if he chooses to go the legal route. He did talk to the owner about covering his co-pay $100 plus perscriptions costs, something like $150 total, they denied it and said they cannot be held liable for what happened. He’s debating legal action, he’s not sure if it’s worth messing with but I’ll stand by him regardless.

The reason for such a ghetto course was they have 5 courses, 4 of which are considerably further away, they have a kick ass gym on the property that almost no one uses and for $450 a year it was a steal, know I know why.

The messed up thing is that if you had a gun and saw a kid pointing a gun at you, you could shoot to defend yourself. A bb gun is considered a lethal weapon, especially if it is technically an air rifle.

Air rifles shoot pellets at 1200 fps + and could penetrate far enough to get yourself killed. It would also be impossible to discern between a bb gun and a rifle (standard) at that distance.

The stupid bastards could hurt someone or get themselves killed.

Did you guys sign a waiver before you could use the facilities? You might want to let them know that when they said it was a known problem they could be held liable for negligence. I’m surprised they didn’t pay your friend the $250 for medical expenses. In fact their insurance should of covered everything. Course it all comes down to how willing/capable your friend is to spend a couple hundred/thousand bucks in legal expenses on a small moral crusade. You don’t need a lawyer for small claims court but if you show up without one and the golf place has one you can bet the judge will side with them.

I don’t golf at all but what part of Missouri was this in? I’m in the K.C. area.

Oh have your friend take pictures and document everything just in case he decides to go to court or use it for some leverage.

Missouri is a conceil carry state, I’m actually glad I’ve been putting off getting my permit, had I been carring that day I could have killed a kid and that would be something that would haunt me the rest of my life. However, it would have been his fault but still.

I signed a waiver when I became a member, he was not a member and signed nothing when we played. Like you said it would be nothing more than a moral victory if he chose to go through with anything legal, that’s what he’s trying to waive. We do have the police report and the medical records from the ER, I will tell him to take pictures of the whole and he kept the BB, there should be enough evidence to make a case.

I’m in Lee’s Summit, this happend in Grandview.

Dude… I fucking loved being a total dick of a kid with my BB gun. I had a daisy and me and a friend went to a local school, shot out some bus windows. Then we get to a huge window on the school. Pumped that sucker up about 30 times and watched the handiwork of safety glass make some awesome web of cracked glass 10 feet high.

Like I said, I was a kid and I know it was dickish, but it was fun.

That said, what the fuck is wrong with kids who want to shoot people or fucking animals??! All I ever did in the woods was smoke pot, chug 'tussin, and look at stolen porn mags. Shooting people just ain’t normal behavior!

I would not have fired in that situation, after the fact. However, if I saw someone aiming a gun at me before the shot, I would definitely fire. You just can’t tell for that distance and take a chance.

Actually, you don’t need a lawyer for small claims, at least in Pa. you just go before the magistrate and tell your story. It costs about 94$ to file a claim, which if you win, they pay.

Isn’t the whole point of concealed carry to defend yourself? If I had a gun on me it would’ve found use in that situation. They were asking for it by shooting at someone they didn’t even have a personal issue with. Who knows what they’ll be doing in a few years? Best defense is a good offense…
