Wanna translate that latin for the rest of us interested commoners?
Posse Comitatus has been violated for many years now, no one’s cared because it’s only “conspiracy theorists” and “fringe” who make a big deal about it.

Sheriff Buelton: They’re gonna lose, General. They’re goin’ down in flames and you’re gonna help me do it. I just got back from the governor’s office, and I can have him call you or he can call your superior if that’s the way you want it. But, either way, I’m gonna see some tanks rollin’ out here to stop that maniac.
Maj. Gen. V.E. Hubik: Go ahead, call anyone you like, sheriff. I don’t take orders from governors. Sergeant Major Carey’s resigned. Besides, he’s committed no major crime in my jurisdiction.
Sheriff Buelton: He stole a god damn tank!
Maj. Gen. V.E. Hubik: It’s his tank he can do what he wants with it! The most I’ve got him on is busting a twenty foot section of fence.
Sheriff Buelton: General, I am the local civilian authority and I am hereby making a formal request of the military to do everything in its power to assist and aid me in apprehending known…
Maj. Gen. V.E. Hubik: Posse Comitatus, sir.
Sheriff Buelton: Did you call me a pussy communist?
Maj. Gen. V.E. Hubik: The U.S. Army is, by an act of congress; Posse Comitatus act, specifically precluded from enforcing civilian law outside the military reservation.
Sheriff Buelton: Pussy communist?
Maj. Gen. V.E. Hubik: That means I do not have the authority to provide you with a single piece of military equipment or personnel without a direct order from my superior or the President of the United States. I can give you his address, if you’d like.
It was a different era, then.
So, basically, the military can’t take orders from civilians other than the President?

Yes and no.
The Federal military is commanded by the President (a civilian) and the Joint Chiefs. The National Guard, on the other hand, is commanded by the governor of their respective states.
So if the soldiers patrolling the streets of Samson, Alabama were members of the Alabama National Guard, who had been duly activated by Governor Riley, then no, it would not have violated the Posse Comitatus Act.
My question is, were they? And if not, who ordered them there?
As I understand it from the link, these are active duty soldiers.

Interesting article on the erosion of posse comitatus.
On a different note, whenever I hear the phrase posse comitatus, I always first think that it is something that occurs right around the timing of coitus interruptus.
/off topic
Any idea who gave the order for this???

Apparently the Army is investigating this matter:

SAMSON, Ala. (AP) – The Army has launched an inquiry into the use of soldiers from Fort Rucker in the town of Samson after the south Alabama shooting massacre.
The Army confirmed Wednesday that 22 military police and an officer were sent to Samson after the mass slaying of 10 people last week. The town’s tiny police force and county officers were stretched to the limit after the shootings.
Some have questioned why Army troops were sent to Samson, suggesting the move was a possible violation of federal law.
An Army spokesman says officials with the Army Training and Doctrine Command are trying to determine what happened. Among the questions is why the troops were sent to Samson and what they did while there.
The Army is investigating it so it doesn’t look like they think they should have been called out either.
It sounds like cooperation between the MP’s on the base and a small town force. The MP’s maintained a security perimeter.
I don’t like to see the military do this type of policing. I’d much prefer a volunteer force of residents be posted to man a road block if that is what is called for.
Like V said before…different era indeed.
