I’m also wondering about the “clomid is a narcotic” charge. Clomid may be a controlled susbtance, but not all controlled substances are narcotics.
If your registration was on extension, you can argue the impoundment was not justified, and therefore, the search was illegal. Will the argument work? Depends on whether the Cali courts are willing to cut police some slack or not.
Be sure your lawyer knows about the extension. And definitely have him or her move to exclude the evidence on that basis. Once that evidence is excluded, there’ll be no case and most likely the charges will get tossed.

Yes it will work unless in good faith your car was impounded which if your attorney is any good they will have to prove. My guess is that if your attorney pushes it they will drop the charges due to the lack of ability to succesfully prosecute you… That is IF YOUR ATTORNEY TAKES A STANCE THAT LETS THEM KNOW THEY WILL HAVE TO PROSECUTE. If your registration is extended and the extension is noted by the dmv then your attorney should be able to get the case thrown out due to improper search and seizure. Its not a question of whether or not there wanting to cut slack to the pd. I wish people who didn’t know what they were talking about wouldn’t try to sound like they do.
Also as stated the clomid IS in fact a controlled substance and technically so would the syringes in california be considered as such although catagorized as paraphenalia. These are prosecutable offences BUT not worth going after if their case is likely to be thrown out based on lack of merit. The problem is that most people will plead out because they can’t afford the attorney fees or they have a lazy attorney that advises them to do so. So thats my .02 and I do know a bit about what I am talking about.

Wow. We use syringes all the time at work to oil small mechanical parts such as high speed camera mechanisms. They work great for those small, hard to reach areas. And the amount of oil on any one area is very controllable with a syringe. In fact, some of the camera parts can only be oiled using a syringe…nothing else.

Hey, P…don’t mean to be the voice of doom here, but I think some of what you’re hearing is a little misguided (unfortunately). I’ve been in federal law enforcement for over 15 years, so although I’m not a lawyer I do have some real world experience on this stuff.
The fact that your registration was technically valid at the time doesn’t throw out the results of their inventory. If the officers at the time, operating in good faith, had reason to believe the car was subject to impound and inventory then the fruits of their search needn’t be dismissed as evidence.
The dismissal business relates to the concept of “fruits of the poisoned tree,” which means that if the reason for their search is inappropriate, then anything they come up with is not acceptable as evidence. But the standard is what a reasonable officer, acting prudently would have believed at the time of the event (without the benefit of 20-20 hindsight). So if those officers honestly believed your registration was bad (for example, if their dispatcher gave them the wrong info, or if the DMV hadn’t updated its records), then the search is good.
It’s akin this: a cop responding to a burglary call, bangs down the door to the wrong apartment (say there aren’t any numbers on the doors). Lo and behold, there’s a guy stuffing a dead body into a plastic bag in the living room. Wrong address, though, so the cop technically needed permission to enter that apartment. Does the guy get away with murder because the cop wouldn’t have known about it if he hadn’t busted in? Nope, because he THOUGHT he had the right apartment, and didn’t intentionally engage in a bad search.
Sorry again to be giving you bad news, but better you shouldn’t truly understand what you’re facing. And, that being said, let me say I think the whole deal about prosecuting for clomid and sticks is bullshit, and not worth taxpayers’ $$.
