I had to get some mail and the apt owner spoke to me again, this time being all sweet and nice… I guess she’s just trying to avoid legal jihad or she really is scared of me or what I might do (I would not do anything illegal or violent concerning the situation).

She told me that the witnesses I spoke to said I yelled at them and cussed at them… neither is true…

She also said people were scared of me and afraid I was going to pop… I wonder who these people are… I imagine the pit owner and the 2 people who made false witness accounts. Possibly other people that they lied to… Damn… there’s nothing I can do about it…

I guess all I have left to do is pray until I can get out of here…

Just a head’s up…but I am used to getting some responses like that. In fact, I would venture that most bigger guys who even work in an office setting (possibly bult women also) get accused of flying off at the handle even if they don’t simply because people easily believe the big guy in the room is crazy and will “rage” on them at any moment.

I have also learned that there isn’t much you can do about that perception once they have it. It is them against you.

This is bizzaro. Did they say what or why you yelled at them? Even if your dog was the aggressor, why would you yell at people who were there?

Dog fight. Break up dog fight. Start yelling at strangers. Just doesn’t fit. In that situation you’re getting your dogs away and checking them out to make sure they are ok. Did you yell at the girl and others took it like you were yelling at everyone?

I’d love to know what they say you yelled, but it sounds like apt manager didn’t tell you and you probably shouldn’t try to find out. Just avoid everyone and get out asap.

Oh no, this is just when I asked them if they said my dog was on a leash. This was also when they told me they’re not allowed to speak to me or the owner of pit. I did not yell or cuss when speaking to them but they said I did.

I’m only about 195lbs and not exactly ripped at that weight at 5’10" (not fat either). My narrow clavicles make it look like even less weight. But I am bigger than most people I go into most rooms who aren’t just fat… I dunno… maybe I am at a size where I have to focus on toning things down.

She lacks hard evidence. I have a clean slate except for a single speeding ticket. She would be filing the suit a year after the ‘incident’ and right after I ‘coincidentally’ reported her dog.

But… it seems like she has everyone on her side (so she has ‘witnesses’ and ‘testimony’).

From what I understand, character witnesses are almost never allowed in civil court with the exception of defamation charges. And in criminal cases (if it really is a sexual misconduct charge), I would be the one who would have to ‘open the door’ meaning that character witness would only be allowed in if I started it.

Is there a lawyer that would take her case?

Just because you CAN do something, doesn’t mean it’s advisable. First, you say your shelter dog is perhaps “part pit”. Big difference. I am an expert on the american pitbull terrier - let me just put that out there, not as a brag, but a point-of-reference for my opinion. The NATURAL disposition of the american pitbull terrier is to be dog aggressive (“DA”). It does not mean they are all DA or that DA can never be controlled, but it does make the breed a poor candidate for off-the-leash excursions amongst other dogs. In fact, an american pitbull terrier should NEVER be off-leash in a public setting, let alone other dogs. Add to the fact that the average owner is EXTREMELY ILL-EQUIPPED TO BREAK UP A FIGHT, and you have a disaster-in-waiting. PITBULLS ARE NOT DOG PARK DOGS. If the dog park experience is important to you, get a different breed. No one with any real time and experience with the breed would ever tell you it’s advisable to have a pitbull off leash in a dog park.

Now, to where we “agree”. If a pitbull really engaged his dog, he’d probably have no chance of thwarting the attack. I’m sure there was a “dust-up” or some threat displays - something happened, but as it concerns the point of the story, it really doesn’t matter in my opinion.

The reason that I told the apt. first and not animal control is b/c I didn’t want to see the pit go to the pound, I just didn’t want it in the dog park around other dogs and children.

Yeah man nothing but respect for you. It just drives me nuts watching these ignorant people condemning the dog for acting exactly how it’s supposed to act. Pit bulls are animal aggressive and usually people friendly, those are the traits that were intentionally bred into these dogs - and ignorant people continue to make the same damn mistake as this owner. It shouldn’t have been at the dog park in the first place…and its the owners fault that it was put into that situation, NOT the dog’s.

It’s like taking a little toddler and leaving them unattended in a room full of nothing but fine china, just to see if you’ll get lucky and he won’t act on his natural instinct to touch everything in the room. Whose fault is it really when he inevitably breaks something?

Another thing, is I overheard the pit owner several months ago say that another guy had reported her pit. Not that it seems to matter at this point.

UPDATE (good stuff):

I’m at my new place and have been for over a month and I am doing awsome here. I love it. I also found out that psycho-girl has been evicted! Karma’s a bitch lol. I heard it had to do with a combination of other incidents involving her dog and the apartment manager being tired of dealing with her bullshit. Like everytime her dog had an incident, she would run to the office and cry about how terrible the other person and their dog is. I am so happy today :smiley:
