No, first such seizure would almost certainly be under a “dangerous dog” act. And a dangerous dog act usually requires an attack of some sort, then a court hearing to determine the dog as “dangerous”. That usually requires a “bite”. It doesn’t sound like that occurred here. I’d raise hell that you are being denied access to the park, ask out of your lease, and avoid any penalties. And, if you really are worried, you’re certainly entitled to know that the dog has had it’s rabies. Rabies is part of dog registration and is required by law. Inquire at your local town hall and check with the folks that keep those records. They should be public.

Unfortunately that letter is pretty reasonable. They are not denying you entry to the park. I see little recourse for you other than starting some legal jihad over this and you have less than 2 months lease left and you want to leave anyway.
It’s unfair if your story is correct. Life is not always fair. Avoid the park. Move. It sucks, but it’s the only pragmatic recourse.
I don’t have the time, money, or energy to get legal about it. That’s stuff better spent on school and getting hyooge and swolz. I just hope the pit owner isn’t crazy enough to make it legal (she is pretty damn crazy). I heard that there’s no time limit on reporting dog bites. If I find that’s true I might just report after I move to avoid any vindictive actions from the apt. owner concerning my lease or access to facilities or me being able to have the pets here.

One thing I’ve learned…is that old people in apartments HATE young people in apartments. It is like some deep seated need for them to constantly try to fuck with anyone under the age of 40 who can still get laid.

If I just up and move, I have to pay penalties which would cost more than just staying for the 1.5 months and I can’t afford to pay double rent. 1.5 months isn’t that long to put up with this kind of BS. I’m just concerned about potential harm the pitbull may cause (children go to that dogpark). The dog attack may be grounds for breaking your lease but that is of course up to you if you wish to pursue.
Dogs fight when the get together, it is hard to say if the pit is overly aggressive based on this incident.

Yes. When dealing with the authorities and dogs it can be a one strike and you are out issue. While unlikely it is possible. Best to keep the cops out of it unless you are willing to go all the way and prepared to deal with the fall out and paying for a lawyer.

A cop came to my apartment saying that she was complaining of me sexually harrassing and groping her a year ago. Reality is she let me kiss her, then she gently pushed me away at which point I stopped advancing (her body language was saying yes like arching her back and giving me her neck). She’s not pressing charges according to the cop, but has issued a no trespassing order against me… Her friends are agreeing with her of course and saying that’s what she told them.
This is so fucked up on so many different levels.
They allow an aggressive dog into the dogpark.
They’re allowing this girl to slander me.
And people are buying it b/c she’s more popular than me and a cute girl… so fucked up.

If you can, you might want to get a dog-sitter for the remainder of the time. Just stay at work/school/gym as much as possible. Fuck it, maybe crash somewhere for a month. I’m taking paths well away from the dogpark when others are there. I haven’t contacted her in over 6 months. I’m moving out spring break (begins March 12). I can’t afford too much time with two apartment rents. I hope it’s soon enough… but finances won’t allow me to do it sooner.
And I would like to thank all of you. I’ve gotten some great advice and a few laughs and an avenue to help me express my concerns and chill out.
i know you said you dont want to get the law involved but given her stating you sexually harassed her you can always counter with slander. granted it may be a losing battle, they do take false sexual harassment cases seriously.
two of my friends were contacted by the police after they did some MFM, yeah true story, and the girl said they raped her. this was after people found out and she then “regretted doing it”. they both counter sued her for slander, defamation of name? maybe. and needless to say she was in a lot of trouble. she lost because there were enough people, both male and female, who heard the girl talking about doing it prior to the actual act. we all had to go to the PD and such, it was a pain in the ass but much better than letting some of my friends never having a decent job bc someone claimed they raped her.
it also seems like youve got the short end of the stick if these other people just agree with whataver she says. it seems like youre on a college campus, if im correct, you are correct in no matter how you go about it, it will be a popularity contest and its not worth the fight.
granted it seems your best bet is to wait it out and then GTFO dont let someone ruin your life like that. I hate hate hate people like her who play the, im just a girl everyone feel bad for me card to get their way. the dog attack is one thing, but to say you sexually harassed her is well across that line if you ask me.
you can always just subtly start ruining her without her knowing its you. and eventually shell lose it end up in a psych ward and you can sleep happy lol.
I don’t have anyone that can vouch for slander because everyone believes everything she says. The officer who I spoke to was very friendly and was giving me good and helpful advice. Mostly, he said that if I see her it’s in my best interest to turn the other way and to avoid her. I think the only reason she’s not making a lawsuit is because she knows that she doesn’t have any proof.
She’s starting to sound like a borderline sociopath. When you get on the wrong side of these people they go into a mode of all out warfare. Often they are very persuasive as this girl is showing by getting so many on her side, even willing to lie for her. Either that or she’s so persuasive she is able to bend their memory of what happened in the two incidents.
Do as people are saying by laying low and getting out as soon as you can or sooner if you can crash at friends or family. Also, be very careful for your own safety. The type of girl I’m beginning to think she is is the type who might be bad mouthing you to a bunch of guy friends to the point they may decide you need a good ass kicking.
Look out for your dogs, too. Make sure there is never a chance someone could poison them or hurt them in anyway. It would probably be a good idea to document and be able to prove where you are at all times. Pain in the ass but it is possible with the help of friends, cell phones and other tech.
The next 6 weeks may seem like it takes forever but keep your head and be smart. It will eventually be over.
