On some level I get the rape by deception thing. Imagine a blind woman has sex with a man who leads her to believe that he is her husband, when in fact he is not. The sex was consensual, but the consent was based on false pretenses. Or imagine a woman who has unforced sex with a man she believes is her husband but who is in fact his estranged and evil (but identical) twin. Is that not rape?
That said, saying it is rape based on a lie about religion seems extreme. Women have to have some accountability for their own actions. If sleeping with a Jew—and only a Jew—is that important to her, you would have expected her to take more steps to vet his Jewishness other than him saying so.
I think this is setting dangerous precedent. I don’t know where to draw the line but I can tell you it’s not where the court drew it. And I’m an Israel-loving Jew, BTW.
COMPLETELY OFF TOPIC:
Is that your high school’s mascot? (avatar)
Not rape by force or coercion. By deception. He lied about his religion and nationality to the girl so she would CONSENSUALLY have sex, and thus…it’s rape. In Israel.
And how many men have not lied about going to church, their job, their martial status, etc. to get laid?
And why is she not being busted on for fornication? If we’re going to be strict and Biblical.
Im not claiming to be an expert on israeli law but I am pretty sure they have a modern judicial system not one based on old testament laws. Still this is an obvious miscarriage of justice.
No, seriously, this is OBVIOUSLY racially charged; no two ways about it. This is Israel showing their douchebag feathers again.
The last part was unnecessary. One could draw some very inaccurate and unfortunate impressions about the United States by reviewing any number of our court decisions. Note also that a number of Israelis were quoted in the article as disapproving the decision. I think their is at least a decent chance the decision gets overturned.
Also, let’s be clear about one thing: If the situation was reversed (Jewish man “raping” by deception an Arab woman in an Arab country), not only would the Jew be jailed for life or executed, but there would not be a SINGLE dissenting Arab voice. (This hypothetical is largely academic, because Jews wouldn’t even be allowed to live in an Arab country to begin with.) Let’s not try to pretend two things are the same when they clearly are not.

Rape by deception is also the law in most states in the USA.
Typically, it’s not used much, but there was one recent case where an identical twin screwed his twin brother’s wife, claiming to be his brother back from Iraq after being gone six months.
So, be careful all you wanna-be George Castanzas (who pretended to be an archetect) — it’s the law here, too.

I am an Israeli lawyer. It’s no more based on the Torah than US Law. That said, most of the underlying principals of any former English colony (down to forgiving debts every seven years – heard of “Chapter 7”) can be traced back very clearly to the Torah.
I think religion isn’t really involved. Being Jewish is no longer just the Religious aspect but also what people perceive as a cultural identity. I know many people (Who I get very irritated with) who say they are Jewish…but atheist or half Jewish and half catholic.
Sorry but it doesn’t work that way…Anyone can be Jewish as long as they are of the jewish faith, but people think of Jews as mostly Eastern European…“Jew fro” etc.
I am torn by the rape by deception thing.I feel like hes a piece of shit for lying to her in order to get sex but in reality people do it all the time, men and women.

Arabs (who descend from Ishmael) get “clipped” on their 12th (?) birthday, same as Ismael.
Speaking of which, check this prediction out from Genesis:
God heard the boy [Ishmael] crying, and the angel of God called to Hagar from heaven and said to her, "What is the matter, Hagar? Do not be afraid; God has heard the boy crying as he lies there. 18 Lift the boy up and take him by the hand, for I will make him into a great nation.
…
“He will be a wild donkey of a man; his hand will be against everyone and everyone’s hand against him, and he will live in hostility toward [b] all his brothers.”
…
These are the names of the sons of Ishmael, listed in the order of their birth: Nebaioth the firstborn of Ishmael, Kedar, Adbeel, Mibsam, 14 Mishma, Dumah, Massa, 15 Hadad, Tema, Jetur, Naphish and Kedemah. 16 These were the sons of Ishmael, and these are the names of the twelve tribal rulers according to their settlements and camps. 17 Altogether, Ishmael lived a hundred and thirty-seven years. He breathed his last and died, and he was gathered to his people. 18 His descendants settled in the area from Havilah to Shur, near the border of Egypt, as you go toward Asshur. And they lived in hostility toward [c] all their brothers.
Someone have the balls to say this prophecy did not come true.

Painting with a pretty broad brush there.
No it’s not. Jewish citizens were effectively expelled and/or “ethnically cleansed” from any country that is majority arab or muslim. There are a few hard core hanging on in a couple countries, but they are in the 10s or 100s, instead of million +.

HAH! I just started re-reading the bible the last couple weeks and yesterday finished Leviticus.
