From my understanding he left his comments on pages OPEN for comments - a FB page and a memorial page. I think he should be acquitted because he should be allowed to leave comments on an OPEN forum. Had he chosen to seek out the victim’s parents PERSONAL emails and PERSONAL telephone numbers I would agree with you.
IMO it’s the moderators who are at fault on this one. It’s their job to step in and make sure this type of stuff gets deleted immediately.

How do you expect a memorial page to be anything other than open? The idea is to honor the deceased not poke fun at the parents and laugh at their child’s death…are we really having this conversation?

You can’t equate physically shitting on a corpse to written comments. However I would not consider it illegal to protest a funeral in the same way the WBC chooses to do so.
My friends and I have a memorial page on FB for one of my friends who died in a car accident. It’s invite only or a person can request to join it. That’s what should have been done.
I agree mods aren’t infallible but generally it takes Facebook FOREVER to respond to flagged comments.
The reality is, a line does need to be drawn. If someone logged on and posted directions to your house, pictures of your family and pets with the eyes cut out on a forum of serial killers, I am guessing you wouldn’t take it lightly.
