The judges have to make decisions when cases are brought before them. Whining about not liking their decisions is pure bullshit.

The elected officials have the power to change the rules if the judges have made decisions that the public does not like. This goes all the way to congress where the constitution itself can be amended if necessary.

What we are really hearing is ongoing whining about how bad the judges are because their opinions are not always ones you happen to agree with.

Don’t like the decision? Then get the laws of the land changed. Can’t? Well, then that’s the role the judges play, to interpret the current law of the land and how it is to be applied.

That’s it. That’s the process. That’s your system. Boo hoo. Sniff. It’s all the judges fault.

But that isn’t what you are advocating. Legislatures act as a check on judiciaries - sure they do. What good is passing laws if judges ignore them and make up what they want? The check ceases to exist.

The legislature can’t be a check on the judiciary if the judiciary is free to ignore the law the legislature passes and is not bound by the law the legislature passes. Poor Vroom.

So judges who overstep their bounds should be tolerated because they’re judges?

All judges interpret the various laws and documents. Just look at the threads we’ve had here in the past about the separation of church and state. The way the US Constitution is worded, you can interpret it in different ways that all have some validity.

We have to be careful that judges are not used to go around the legislative process. Elected officials propose and adopt the laws. Unelected judges making end runs around that process rob it of any legitimity. Especially when (supreme court) judges are named for lifetime nominations.

We had a similar case here in Canada a while ago, when Jean Chretien tried to get the Canadian Supreme court to rule that whatever question was presented to Quebecers in an eventual referendum on sovereignty, would need to have the approval of the rest of Canada. The court’s ruling in that case, while rather nuanced, basically came down to the fact that if Canada wanted to ignore a positive result in any referendum, it would have to do so without hiding behind the Canadian Supreme Court.

Had the judgment been different, how many would have agreed with a ruling that would have basically stipulated that the result of a popular vote could be ignored?

I’m sure many non-Quebecers would have agreed with it, because they’d agree with the outcome. But as a question of principle, judges should rule on the cases put to them according to the laws of the time, they should not make broad, sweeping pronouncements that thwart laws that have been voted for by the people.

In specific cases, such as gay marriage or stem cell research, if people vote against them, I’m all for respecting their wishes. That’s what the democratic process is for. Even if overturning both of those decision in court agrees with my personal views, I don’t think it should be tolerated.

You guys need to slow down a bit. The judicial system is another branch of government, and it has a set of rules that it is supposed to follow as well.

Will there be bad judges? Sure. Just like there are bad politicians. Is there a process for removing them or overruling their judgment? Of course.

However, the final authority rests with the legislative branch. It isn’t fast, and it isn’t easy, but that is the way it was designed. Often, laws are written and stay on the books for so long that they get harder and harder to apply appropriately to current events.

In that situation, the courts still have to make a decision based on existing law. In reality, what may be required is enacting some more up to date and clear legislation so that the judicial system has less open space in which to get lost when making a decision.

It’s the process guys… don’t whine to me about it if you don’t like the way it works. Talk to your politicians about amending the constitution or making new laws. If you can’t get enough votes to do it, then the courts and judges may not be as out of line as you think they are.

Now, if the two of you aren’t done thinking I’m an idiot because that’s how the system is designed, then by all means, fire off another round of shots.
