I agree. I have a few friends that are officers here and they’ve all said that people will ‘fail’ the FST even when they are well under the legal limit. Many will fail simply because they are nervous.

FST are NOT required to be taken in most states(all if I remember correctly, you must take a chemical test although). In fact field sobriety tests are designed to failed. Don’t believe me? A study was done with 21 completely sober people(0.00BAC) completing FST. 14 police officers were asked to review the tapes(they did not know they all had 0.00BAC), they said 46% of the people had too much to drink.

It’s horrible and most people do not know their rights! I was amazed to learn a few months ago that I have the right to refuse these and it is advised I do. Even though I never drink and drive(zero tolerance here), it still pisses me off that police are TRYING to put innocent people(if they do not have probable cause to administer the Breathalyzer) in jail.

Doing donuts in the parking lot was dumb. His interaction with the cops was not very dumb. There is little incentive to cooperate when you are caught doing something very stupid.

A cop may be lenient when you roll a stop sign. It is unlikely he will be when he catches you doing donuts with beer on your breath.

Cops are definitely not lenient if your doing donuts or even just a burn out.

A couple of months ago, here in my city, four teens were in a popular hangout on a Sunday night. Well the driver of a Chevrolet Silverado did a burn out and the cops caught him and wanted to pull him over. The teen driver then tried to outrun the officer which led to a high speed chase. Maybe 5 miles down the chase, the driver got into the expressway but then as he was exiting, he hit the curb and the truck flipped over a couple times killing all four passengers, two male and female teens.

Even if you drive by there today, you can still see where the tires hit the curb and the marks left on the wall on the expressway. Sad story.

And yes, it is perfectly legal to sober up while sitting in your car so long as your keys are NOT in the ignition.

You are right, county jail sucks to no end. Why you spend 2 weeks in the county for a deuce is beyond me. That must have been one hell of a deuce, or you had an outstanding warrant. I met a guy who was fighting a Fed beef for 2 years, asking me what month it was his sense of time was so warped. Stay out of the county everyone.

you didn’t get a DUI yet. You haven’t been convicted. Just take this as a cheap lesson and learn from it. A cab ride or a cheap no-tell motel is a LOT cheaper than a DUI conviction.
What you did was stupid. Be it isn’t a major hurdle. You got off cheap. No injuries to ourself or others.
Play the racket and get an attorney. Maybe you can talk with the DA before this get it dropped yourself.

I didn’t plan on drinking that night.

I didn’t know there were going to be so many beautiful women there.

I got a DUI when I was 18. I can empathize because I knew so little about alcohol and was very naive (never drank in highschool or anything). How old are you? My situation may be a little different since I was so young and I haven’t had anything on my record before or after (I’m 22 now). I’ve had no problems getting internships or summer jobs. In fact I got a pretty competitive internship this summer and I even had to list my prior misdemeanor offenses on the application.

If you get charged, your life will suck for up to 1 year (depending on the state). I had to go through a ton of bullshit and lost my license for 8 months. But I came out of it much more mature and wise. Best of luck to you.
