he woke up to a cop knocking on the window asking him if he was alright.
he got a dui because the keys was in his direct control.

he got 3 years state prison for that dui

Actually, it would not surprise me if this were a second or third DUI, the first two actually having been moving violations. A first, non-moving violation entailing a 3 year state sentence just seems improbable, unless it was a suspended sentence.

if it makes you feel any better, i too got a dui after doing donuts in a blank parking lot. unforunately i had sober PASSENGER!!! wtf! i know, but the good thing is i got the charges lowered with the help of a lawyer and only got 12 months of probation because i pled 1st defender or whatever. i sugguest you fight the charge, plead not guilty. the breathalizer at the station is what really counts, the ones at the car can be inaccurate.

he is a passive guy and he said fine I will be back in the morning and we will talk and he went outside to sleep it off.
so yes it was a second but az state laws on dui are strict.
Second Arizona DUI Offense Plus:
Criminal Status: Class 1 misdemeanor.
Jail: DUI: 30-90 days. For extreme DUI, 60-120 days. For aggravated DUI, maximum 2 year prison term.
it was aggravated becasue of the BAC was so high at the time and
he did choose to not take the 5 years probation he was able to plea down to one extra year prison got out free and clear and moved away.
havent been in jail since moving away.
he really was just sleeping in the car because he didnt want to hear her crap. he was dropped off at home by a buddy of his so he wasnt driving that night.
