You will also have AA to do which will be an inconvenience, but its not like you are screwed for life. I hate when people think shit like this because others who have no idea put out falsa propaganda.
I was once assigned to see an LCSW who had 4 DUI’s in his life, and he was able to drive and live life without incident. Do your homework and get it done. Don’t fuck with the court. Just do what they ask, get out of their hair and move on.
Getting a lawyer will help, you could always question the accuracy of the breathalizer, but that hasnt worked much in the past. The judge will probably go easy on you, so just be smarter in the future. Your life will be fine, just make smarter decisions is all.

As far as I know, in Mass., the field breathalyzer is not admissable in court - only the one at the station is valid.
And, just so ya know, everyone who doesn’t fall over and break their nose thinks they “pass” the field sobriety test. Personally, I think it’s useless to begin with.
The better your lawyer the less you have to worry. More likely the officer just wanted you to stay the night because he thought you were stupid. If you got caught jerking off and smoking weed in the car recently, you may be pretty bad off. Otherwise your just out $750 for the lawyer.

I agree. I have a few friends that are officers here and they’ve all said that people will ‘fail’ the FST even when they are well under the legal limit. Many will fail simply because they are nervous.

The car was running and it was moving so he was driving.
Doing doughnuts in a parking lot at night when he’s drying out shows a level of impairment that someone who hadn’t been drinking wouldn’t have.
Being drunk has NOTHING to do with it. Having a blood alcohol level that is highly correlated with a dangerous decline in ones reflexes and their ability to drive is why the charge is driving under the influence.

About two weeks ago there was a story in the news about a guy who got arrested for sitting in his parked car with the ignition on while he was drying out. So my arrest is not outrageous or unfair by any stretch, and I never implied that it was.

FST are NOT required to be taken in most states(all if I remember correctly, you must take a chemical test although). In fact field sobriety tests are designed to failed. Don’t believe me? A study was done with 21 completely sober people(0.00BAC) completing FST. 14 police officers were asked to review the tapes(they did not know they all had 0.00BAC), they said 46% of the people had too much to drink.
