They need to show that she consciously fired a gun. Firing a gun and thinking it is a taser excludes the action from being consciously done.

So circling back to your example:

This would not be 2nd degree manslaughter in MN.

The cop who shot Jacob Blake has returned to work. It was decided he acted appropriately.

How much training is done with a pistol vs a taser? It’s muscle memory. The officer has probably drawn her gun many more times than her taser. In the heat of the moment, feeling fear, her body did what it has been trained to do. Her brain, and mouth, said taser but her body moved the way it has been trained to. At least that’s my take on it.

Yeah I’m right here. It’s a tragedy, it shouldn’t have happened, but frankly I don’t think it’s the right hill to die on for politics. This is not the one to make an example of.

I think this is one reason to invest in more training hours with multiple tools, and with more high stress situations (mimicked). This is an unavoidable outcome of training a certain way and then getting put in a fight or flight situation. This is also an outcome of minimum training hours - whether due to budget, department time, or policy.

Combining minimum training hours with a limited testing protocol (i.e. only pistol, or mostly pistol) and low stress environment (i.e. gun range and not reaction based with distractions) is a surefire way to get terrible and potentially tragic results.

It’s like the guy who takes a taekwondo class 2x a week and does one of those ā€œknife disarmā€ training drills thinking they can take a knife out of a hardened criminals hands. It’s predictable, it’s tragic, and it’s avoidable through better training in high pressure and with more emphasis on situation awareness/area egress rather than hero moves.

I see much of the ongoing PD training the same for standard officers (i.e. not SWAT or tactical groups). However I’m nowhere near informed so I’m going to leave it there. Idaho, marine, and others who work in related fields would know much better.

I honestly don’t believe more money will be spent paying cops for not working. We will just accept that some people who shouldn’t get killed will get killed. And the cop will then be sacrificed to an angry public.

And the debate will rage as to what the role of police should be, and what level of force and aggression is acceptable to society.

I agree with this. I just don’t think the actions justify second degree manslaughter.

Nor do I. But I think there is enough there to charge her. Shitty situation.

One helluva lot more than is acceptable against the rich.

Which also leads to what level of violent crime do we accept among the poor.

They almost had to charge her to quell the riots. My guess is she will get out on bail with a low bail amount, then in the months following the prosecution will drop the case (they don’t take cases they are likely to lose).

The cop who shot Jacob Blake is a free man, back on the job. I haven’t heard any complaints or seen any riots. They’ll give the dead guy’s family a payoff and in a few months drop the charges.

Losing her job, being charged and humiliated. Still probably nothing compared to the crushing guilt she feels for her simple mistake.

I bet at some point she meets with the family and is publicly forgiven.

My wife is Mexican. I could write a ten volume book on Mexican culture. I believe anyone that has spent a decent amount of time around Mexicans could do the same. From family dynamics, to music, food, architecture, television, humor.

Idk on this one. Seems they think it should be a murder charge (no chance on that one). Imo, when the case gets dropped, they are going to think this lady is a murder who walked free.

But they won’t say anything after they get paid. Raising criminals pays.

Where did she say that? I saw her saying to tone down the rioting, and she just wants her child back. Also, those comments came before video was released.

Just what I’ve heard on mpr (minnesota npr). They have interviewed the victim’s family.

Part of the issue is that many people have very limited knowledge of the law.
