That’s what I ment though. When the employees were hired to work for your company did they have to pass a drug test? If not they shouldn’t be required to pass one now without notice. If they did have to pass a drug test when they were first hired then a surprise test isn’t that out of line, dick move for sure but nothing out of line per say.

The problem people run into with “what I do on my own time is my business” is that doing drugs is illegal. I agree to each his own, but if the hobby you partake in is illegal, your argument loses alot of legitimacy. What I suggest people do is either protest or appeal the outcome of a positive drug test by suggesting that the test reulsted in a false-positive. No urine test is considered full proof, so you could then ask for a retest, which in the mean time you would need to get yourself cleaned up with a detox protocol.
I had a roommate in a halfway house test positive for opium by eating a poppyseed bagel (not joking), and protested and eventually won his appeal. With marijuana, you could claim you drink a shit ton of green tea would could yield a false positive for THC (marijuana), but I am not sure anyone would buy it.
Here is another way to look at it. What if there was increase of people doing drugs while at work or dealing drugs. And upper mgt were tipped off by law enforcement or there own internal investigators(yes lots of companies do this). In some factories around here people talk about doing/selling coke on the line etc etc.
Also speaking from quality control would you want something that was made by someone who could not concentrate cause they were jonzen from the binge they are still on? Would the product be safe? Would you feel safe with someone like that around that would do almost anything for a fix?
If you wanted to get rid of that kinda shit from your factory. What do you do? Random tests. This could be a way to prune the workforce but this could also be something else going on that your not in the loop on. Could it be that upper mgt knows your really close to the workers and telling you a young guy cause that could risk what they are up too?
Also what about new contracts. Some new company is going to hand your company something to keep everyone working. But has a zero tolerance policy. They could dictate to your company the new testing policy.
Point is could be many things that spawned the recent outbreak of testing besides saving money.

What if there are a lot of people who are staying up all night before work, and that MAY be causing work problems, does that mean management should have the right to put monitors in everybody’s bedroom to make sure they are going to sleep by 10 PM? Doesn’t that sound invasive? For me, it’s even more invasive to allow them to probe my body, in this case piss.
If somebody is fucking off at work, fine, do what you have to do…but that does not give you a Big Brother license to peer into the bodily fluids of your employees.

Well the simple fact of the matter is that younger people MOVE FASTER than older people. I don’t think there is any argument that can be made that proves that otherwise.
My product is a manual and hard process and I have the data that backs me up showing that employee X (who is young) builds parts faster than employee Y (who is closer to retirement). This is called Productivity.
my company is not a US company so age discrimination does not come into play for 90% of our plants. For the other 10% I would say that it still does but like you said it’s illegal. I myself was denied a promotion for being “too young”.
I would never fire an old lady for this. Rather I would fire the lazy asses who keep calling out “sick”.
Finally, no old lady will give me a beating as I can simply move out of the way faster than she can react and she’ll just break a hip

I would argue that we do not have a drug problem at our plant. I walk the lines daily and have never seen anyone acting unsual and honestly our lines are so faced paced that if they were trying to deal drugs out on the floor I would be able to see a slow down in product or at the very least a bottle neck.
We also haven’t had a workplace accident in months, again showing that people in general, are not showing up stoned.

Having worked in manual processes I’ve seen that young people have to move faster in order to complete the same amount of work older people do. Older folks work smarter, not faster.
Another thing to consider - if someone has workplace accident and kills/maims someone, I bet OSHA would come in and give a drug test. If the fines don’t cripple the factory, the family’s lawyers are going to come after the company and argue that there should have been random testing.
I don’t think it’s entirely ethical either, but mgmt does have a point.

In my experience older people are by far better and more reliable workers than the young. I am only 30 and I have seen this time and again over the past 8 years.
I agree, the test seems sort of unfair. However, every single job I’ve ever worked had me sign a paper that said they reserved the right to drug-test me at any time. When you sign that paper, THAT is when you should make your argument if you have one. Don’t sign shit that you don’t intend on following. I learned that when I was like…10 years old.
