Why would he use inflammatory language and blame all the problems with the country on anti-vaxxers and anti-maskers right before a 20th anniversary of the twin towers

The media will create the narrative going into the election

And Biden is going there to campaign for Newsome

All politicians do this right before any election, especially for a big one like california…what happens in California will effect 2022 midterms

I think we are past the need for politicians to distract. Spin plus 24 hour news cycles plus short attention spans.

Then we have to be seriously concerned. Joe Biden is pulling a dictator move which is unconstitutional. Shouldnt that vax mandate pass congress first?

And yes it’s unconstitutional, but if the judicial and executive are at loggerheads the judicial has not enforcement authority. His unconstitutional edict may lose, but he just makes another one which will be enforced until that one loses, then rinse and repeat.
What happens when the branch most in charge of defending the constitution breaks it regularly.

Imagine if the media just let it slip who is the most anti-vax and unvaccinated group in the country is? It’s not republicans, nor conservatives, nor governors, it’s the black community, by a large margin.
This is the lie of the media. They are trying to put the focus of derision on a fairly well vaccinated group. The black community is the most resistant to these vaccines, but shhh. You cannot say that. But here it is:

What do you mean? I think it’s quite obvious that blacks are more likely to refuse vaccinations in states with almost no blacks than in places with sizable black populations…wait a minute…

The possible silver lining of the vaccine mandate is that it may lead to legal rulings that undercut federal power more generally. Maybe I am overly optimistic.

However, there are a number of issues.

  1. Does the US Congress have constitutional authority to regulate workplace conditions? It is quite a stretch to get from interstate commerce to workplace safety and all other Congressional powers seem to be even further removed. As such, workplace safety regulations should likely fall to the states, not the US Congress.
  2. Even if we ignore point 1 and accept that Congress can regulate workplace safety, the legislation creating OSHA is extremely broad and delegates far too much of the detail to the executive branch. This is a problem with many federal agencies and not just OSHA.
  3. Even if OSHA can exist in its current form, it’s authority to regulate public health is rather questionable.

For these reasons, I am optimistic that court rulings will not only throw out the vaccine mandate, but may also go much further by ruling on parts of questions 1 and 2. This would end up with a precedent that greatly undercuts the authority of the administrative state. We may yet look back and see that the vaccine mandate was the step too far that began the unraveling of the bureaucracy. One can hope.

Congress? Potentially… So long it’s not challenged for constitutional muster. But it is much harder to challenge a fully vetted congressional bill than an edict from the president. However, the president can just reissue the mandate over and over again. The weakness with the judicial branch is it relies on the executive for enforcement. If the executive is out of sink with that responsibility, well then Biden can just keep reissuing edits until the other side runs out of money to fight it, which may be the plan.

I am optimistic this will be defeated in court. I am not optimistic that he won’t just reissue it. He did it with the eviction mandates. Change a couple of words and resign it. So I don’t have much hope, I do not trust the government. They have lied way too many times especially about covid.

That KFF data can be cross referenced with % of race per state. It would have been more informative if they did the legwork and showed % vaccinated per racial/ethnic group total imo.

Pat’s is more of a lifetime achievement thing if you’ve been here for forever. He has a ton of posts on here over years and is pretty notorious for being nuts. It’s not surprising he doesn’t want to do the data work for you as he glanced at the data and it doesn’t matter if it doesn’t say what he thought it did. He has a long history of linking stuff on headlines or glances and then being called out for not even reading the stuff. Then he gets defensive about it, puts everyone who calls him out on ignore, and goes into hiding for a few months.
