Apartment Bans U.S. Flags

Imagine a tenant has a 6 month+ rental agreement (lease). When he signed the agreement he was allowed to park his car and display a flag.

Now they come along and tell him he can no longer do that because it might hurt somebodies feelings. The right thing to do is to tell them to fuck off.

I suspect they are breaching the lease agreement and at the least must now allow you to break the contract without penalty.

Sure most contracts have wording along the lines of “can be modified at any time” etc but those lines don’t mean much legally. (Note: IANAL but I have had a few run ins with landlords)

Oh it will certainly hurt business now. They should be allowed to restrict what people can fly on their cars (for new tenants at least - see previous post). However, I think it is good that the issue was covered in the local paper. Now everyone in the area will know they won’t let you fly the American flag.

That can’t be good for business. Even if you have no respect for the American flag it shows that the landlords like to implement and enforce these sorts of ridiculous rules.

That’s the question I have about it too. I suspect there’s probably some clause in the lease giving Oaks Apartments pretty considerable authority. The last lease that I signed pretty much had me by the balls.

How can you say it’s not good for their business? Maybe the rule is enforced because they have found it to be good for their business. Everyone here is acting like they’re the one’s operating this complex.

I wonder what the fathers and forefathers of this country would think, if they knew at some point they would be told they could not fly the American Flag in America. Absolute fucking failure.

I kind of imagine the founders urging us to fly a new flag, at this point.

As I understand it, nobody can fly any flag. Correct?

I think they would be quite pleased that contracts and property rights still exist beyond what the mob desires.

It doesn’t seem to me that the U.S. founders were jingoist rah rah patriots in the sense that we all identify in modern times,where the objects and idols of patriotism have been imbued with some kind of mystical qualities.

They strike me as far more measured and sober than that.I don’t think that the this particular flag issue would worry them one bit.

Hmm no decals either? Are they going to start monitoring bumper stickers on cars, too?

Because there are a lot of people who like to have the ability to fly their flag. Now some other places I know of have similar rules however they are hidden deep within the rental agreement and never specifically mention flags. So by the time you realise you have already signed a lease.

For Oaks Apartments the issue has been pushed to the forefront. And I think it will be bad for business. It shows they want to exert unreasonable control over what the tenants can do.

Yeah they always have catch all phrases. But these clauses don’t mean much.

They can’t make significant changes to the already established conditions regardless of these vague clauses. Conditions that if present initially would have made you run a mile. Now of course you would have to argue that being unable to fly the American flag was such a condition.

To be honest I would just check out the local countys parking info. Get a permit if required and then park with my big American flag out on the street in front of the apartments.
