I would say a reasonable person doesn’t rely on an unreasonable request to ensure their safety. I don’t consider asking for a larger cup to be at all unreasonable, do you? I mean, the medium and large cups are located about an inch apart.
Have you ever seen a Mcdonalds cup? You can tell the difference.

Who cares what temperature any particular beverage/food needs to be brewed/cooked at?
What are the advantages of actually serving it to people at temperatures that cause 3rd degree burns within seconds?
At any rate, the woman was aware on some level that she may potentially spill her coffee - hence the request for a medium in a large cup. Whether she was aware of the possibility of being burned or simply didn’t want to stain her sweatpants, she made a reasonable request to offset that risk. Whatever McDonald’s employee who was in charge of pouring her drink was too lazy to follow her orders to minimize this risk… which is arguably the reason she sustained that injury.
While we might not agree with her decision to open her cup between her legs while in the car, she clearly did it under the assumption that her request was honored and that she was dealing with a cup that was about half full.
BS. who can’t tell the difference between a full large cup and a half empty one. She knew it was full when she opened it. A reasonable person doesn’t rely of on a specialty request from a fast food place to ensure their safety. Like the pickles guy.
Where did you read she knew the cup was full?

It is not that the request is unreasonable. It’s that it is unreasonable to rely on a fast food service specialty order to ensure safety.

Admittedly, I know very little about McDonald’s choice of coffee cups in 1994… what am I missing?

You can see where the coffee is filled to just by looking at the cup. She would have noticed as it was being handed to her.
Lol, now we’re arguing about cup sizes. John, you’re around my age, I believe, and I’m willing to bet you have no idea what a McD’s coffee cup looked like in 1994. I’ll wait while you google it.
DD - a reasonable person would assume the McD’s order was completed properly. I’d say they get my order right 19 out of 20 times. Is it unreasonable to assume they got the order right?
Push - if you were an expert in the field of coffee consumption I’m sure they could have used your testimony 15 years ago. But sorry, you’re not an expert so you’re statement about hotter coffee being more enjoyable is completely irrelevant.
Besides, all of your arguments are placing more blame on the woman, but none of them completely negates McD’s responsibility.

But I AM an expert in the field of coffee consumption and we ARE retrying the case here so my testimony SHOULD be relevant, right? Should I post a pic of me drinking a cup? While sexually objectifying women?
Yes, please do that. Preferably while objectifying Meesus.
Well, your Honor, maybe all of our arguments are placing more blame on the woman because…the woman is indeed at blame?
Partially to blame, I agree. That’s why you are placing MORE blame on the woman and not ALL of the blame.

I have never, and I mean never been unable to see if a cup of coffee(or any drink) is full or halfway full or anything like that.
I am not arguing about cup sizes, I am saying that you can tell if a cup is full or not without taking off the lid. If it was 180 degree’s you would see an outline on the outside of the cup. Or even a simple shifting of the cup would tell you how full it is. All basic things we all do when we get a drink.
I am not one to defend McDonalds, but they have no blame. The woman was a dumbass and that is it.
