  • The old lady was aware of the physical danger of spilling the coffee. This is evident by the fact that she asked for a large cup that wasn’t completely filled (in addition pulling the car over and such).

  • Also given the weight and feel of a full large cup, it’s evident that she was aware that they had

Here’s where I think your argument falls apart. These are precautions I take, simply because I don’t want a huge coffee stain on me, or my car. I also ask that the cup isn’t completely filled, so I can actually put some god damn cream and sugar in it (God, that drives me nuts when it’s filled to the brim!).

I would never ever expect coffee to be so hot, it would cause third degree burns, and these aren’t actions that indicate she was aware of it either.

I don’t think it’s reasonable for one to expect coffee so hot that spilling it could cause third degree burns, without prior explicit warning. Remember, their coffee was kept unusually hot.

Coffee at that temp. causes 3rd degree burns within 2-7 seconds! I’ve spilled coffee on myself before and did NOT get 3rd degree burns.

Plus there is no way she could have been able to tell how hot that coffee was through a styrofoam cup. They’re meant to insulate!

Take a normal pot of coffee off a comercial burner and pour it in your lap.

It would surprise you to get serious burns?

How about take a freshly cooked pot of chili and stick your hand in it. Or go cook a turkey, cut it open, and shove your hand in that. Or cook a pan of lasagna and dump it in your lap.

Would it surprise you to get serious burns from these. Hell, mexican restaurants serve plates that are hot enough to cause serious burns.

Restaurants everywhere serve food that initially is “unfit for consumption”.

You guys are talking about this like its some miraculous thing that hot food burns. Food hot enough to cause serious burns is an everyday occurrence. A reasonable person is aware of this.

Ever eaten poultry, or well done beef? Some food even requires it to be prepared hotter than that.

165 deg AND UP food is an entirely reasonable EVERY DAY occurrence.

Wow, we’re still debating my bad example. I think that despite the case referenced being about coffee that may or may not have been hot, we can ALL agree that people sue in this country FAR more than anywhere else. Here’s a few BETTER references:

Woman bough a motor home, started driving on the highway, set the cruise control, and went back to make herself a sammich! When the motor home crashed, she sued because she was not specifically told she had to stay in the seat and steer. She sued and won $1,750,000.00 and a new motor home.

Woman fell from the window of the woman’s bathroom to the floor chipping two of her teeth while trying to sneak into a nightclub and avoid the $3.50 cover charge. She sued and won $12,000.00 as well as dental work.

Woman in a restaurant slipped on a spilled soft drink and broke her tail bone. She sued the restaurant and won $113,500.00. (oh yeah, SHE threw the soft drink at her boyfriend during an argument 30 sec before she fell)

I’ve had people try to sue me for damages (lost EMD) for their loans not closing, when they didn’t get me the required documentation to do the loan. (even though I asked for it about a hundred times)
