All because WickedMcDonalds put catsup on a hamburger. Sue them, huh?
Here is the argument I’d make:
-
The old lady was aware of the physical danger of spilling the coffee. This is evident by the fact that she asked for a large cup that wasn’t completely filled (in addition pulling the car over and such).
-
Also given the weight and feel of a full large cup, it’s evident that she was aware that they had

This is so off topic, but anyway.
Here’s where I think your argument falls apart. These are precautions I take, simply because I don’t want a huge coffee stain on me, or my car. I also ask that the cup isn’t completely filled, so I can actually put some god damn cream and sugar in it (God, that drives me nuts when it’s filled to the brim!).
I would never ever expect coffee to be so hot, it would cause third degree burns, and these aren’t actions that indicate she was aware of it either.

Cleaning a coffee stain on her clothes or her car is her responsibility. Sure.

I don’t think it’s reasonable for one to expect coffee so hot that spilling it could cause third degree burns, without prior explicit warning. Remember, their coffee was kept unusually hot.

I don’t think she knew the coffee would burn her.
PWi is about being off topic.
Really? that’s your argument?
She asked for it half full for purposes of cream and sugar? she had the guy pull over and stop, because she didn’t want to stain something?
That’s a huge load of BS and you know it.
