As has been stated, the JOB of the court is to either uphold laws/rulings or strike them down on the basis of whether the law is CONSTITUTIONAL or not. How popular a law or ruling is does not matter in the slightest.

And if that is what actually occurred there would be no issues and it would also not be a focus of either political party. But the fact is appointed judges frequently make decisions based on their own bias, not the law. That is why republicans and democrats push for a political office; so the elected politician can appoint a judge that makes decisions based on a similar political etiology. That is why the system is flawed.

ADDENDUM: I should add that this applies in the U.S. and other developed northern countries. For some reason - I suspect a prevalence of other diseases that can lead to open sores - in more tropical climes and in 3rd-world countries it seems HIV/AIDS is more easily passed to men via heterosexual contact.
