It’s basically the only thing a landlord can hold against a tenant. In almost all other circumstances, the LTB here is pretty much squarely on the side of the tenant.
It’s way too long to type out the story, but my wife and I filed against our landlord last year and were basically told we had an ironclad case against her. We ended up sorting everything out without going to a hearing, luckily.
I’m sure you’re aware of this, but keep every single little bit of correspondence you’ve ever had with your landlord. Emails, texts, letters, proof of rent payments, any receipts for things you’ve fixed yourself — everything. Also, keep a notebook with a detailed timeline of every issue ever experienced, and the correlating correspondence and/or receipts.
If you do file, you’ll meet or conference call with an arbiter, who will hear both sides and ask if you can come to an agreement. If not, you’ll go to a hearing and that’s when all the above ammunition will absolutely bury your landlord.
