I would need some proof for the assertion that one cannot be charged with obstruction of justice, without also being convicted of a crime.
My thought is that one can be charged with obstruction if it is shown that they knowingly deceived prosecutors. Again, I might be wrong, but I would need some sort of evidence to change that position.
That’s not the only perspective on this by a long shot. There’s also a fairly robust debate on whether any action taken by the executive that is an executive prerogative could be obstruction, there are good cases for both sides of that argument.
I would also add that the man tasked with deliberating this punted the issue to William Barr, and, despite being asked in Congress, failed to make the presidentially immunity issue the sole reason for not pursuing it further.
It may have actionable or not, but Mueller passed that deliberation to Barr, so the matter is closed for now.
Edit: I’m also aware that Barr being so openly opposed to suit may have presented Mueller with a fait accompli, and so Mueller declined to opine in the hope that the findings would have a political toll.
