Trump: The First 100 Days

Let’s say you have a son applying for college and he just missed the cut off for his program of choice. You later learn 3 illegals did get accepted to that very program.

How would that make you feel?

What are your feelings about the rollout of his refugee ban? Not on the ban itself, but on the implementation.

How about his representatives (ie Spencer & Kellyanne) CONSISTENTLY dropping the ball. They’re his staff so ultimately his responsibility. Opinions on them?

No quite as easy as expected. Congresspeople are learning that many of their constituents actually like having healthcare.

A ridiculously stupid “law”. I agree that regulations need an overhaul, but this will equate to (to quote your most favorite person in the world) “using a hatchet where you need a scalpel”.

If he’s getting rid of felons and dangerous people, A-Ok with me. If he’s deporting mothers who have been productive members of society for 20 years, not so much.

Then let’s recap some of his other Greatest Hits from the past three weeks:

  • Signd an EO banning Muslims from seven countries that has absolutely gotten smacked down by the courts. A move that angered others in the GOP because he did it without asking for input and offered no warning.

  • Attacked the judiciary for their decision. (When Trump tweeted, in all caps, “SEE YOU IN COURT” after the decision, Gov Inslee from WA responded “Mr. President, we just saw you in court, and we beat you.”

  • Bashed Arnold Schwarzenegger’s “Apprentice” ratings at the National Prayer Breakfast, spent his time bashing the press and discussing his election win during both his Black History Month speech and meeting at the CIA (in front of the Memorial Wall, no less).

  • Threatened to defund UC Berkeley (which he cannot do in isolation)

  • Removed the Chairman of the Joint Chiefs and Director of National Intelligence from the NSC to make way for Steve Bannon

  • Went after Nordstrom (on Twitter, of course) after they cancelled Ivanka’s product line. Kellyanne then jumped in the fray to the point that Jason Chaffetz is actually warning them about ethics violations.

This list could go on. In addition to the above, he has the lowest approval and highest disapproval ratings since these polls began.

So you and I obviously have differing opinions on what a successful start to a presidency looks like.

EDIT: forgot to add the raid in Yemen (which Trump decided on over dinner) the resulted in the death of a Navy Seal, a $90m helicopter and 23 civilians, including children. When McCain criticized the mission, Trump tweeted in response, “He’s been losing so long he doesn’t know how to win anymore”. Sean Spicer called the mission “absolutely a success.”

I already outlined what I consider a successful presidency pre-election :

-Carry out his immigration policy

  • don’t start any new wars

Wait people suddenly care about innocent people dying in the Middle East ???

Well, Trump and Comrade Flynn are dead set on a war with Iran so I guess you can cross this off your list.

Me too. It’s hard to say with a straight face the government doesn’t have a likely chance of prevailing on the merits, given the level of deference afforded the executive.

Interestingly, other members of the 9th Circuit have moved to rehear it en banc.

Where are the limits on EO’s? Are there any? Abraham Lincoln can suspend the writ of habeas corpus with an EO and just ignore the supreme court when they rule against him.

Not that I disagree with a 90 day travel stay so we can “vet” people (the rollout sucked). But what prevents any executive from EOing anything he wants? Trump wants 35% tax rate, done (for example). Why wait for congress? Why have a Congress at all?

I know Obama and Bush 2 had a ton of EO’s… I thought I remembered in Civics class that legislature writes laws and executives execute them. I guess the original point of EO’s was the president telling his administration HOW to execute the laws, not creating new ones. What happened? The whole three co-equal seperate branches thing… not so much.

The President’s source of authority to issue Executive Orders can be found in the Article II, Section 1 of the Constitution which grants to the President the “executive Power.” Section 3 of Article II further directs the President to “take Care that the Laws be faithfully executed.”

I was about to respond, and I’m happy to, but after reading thia again I have to ask - are you being serious or sarcastic?

Because of course there are limits on a president’s use of EOs.

I’ll make one point on the hypothetical tax rate change - if Obama’s executive hijinks are the new precedent, Trump has a solid argument that he can suspend tax obligations written in law and exempt certain people from paying certain taxes. It would be an obnoxious move politically, of course, but he can point to Obama as the precedent setter for such things.

Read the example about Lincoln. There are only limits if the other branches enforce them.

During the New Deal the president simply threatened to pack the court if they kept defying him and bam all the sudden his laws were constitutional.

What are the practical limits in today’s world?

Also my example is silly because the congress controls taxation. Woops.

The Lincoln example is not like any other example. It’s too unique to be a valid comparison and things are different when there’s a rebellion afoot.

As for the practical limits, courts handle challenges to unconstitutional EOs - the Steel Seizure Case being one of the most famous examples:

Congress, too, can do something about it by changing the law that the executive is (improperly) enforcing, but that would require Congress to grow a spine and not always adhere to the party line. That used happen, to a certain degree - Congressional members would turn on a President of the same party when he overreached because they knew that the overreach was bad even if gave them what they wanted from a policy standpoint.

We don’t have that now, and it’s a crime. Now we have a de facto parliamentary system where everyone in the same party lines up behind their President like a pack of servile lemmings. A President can throw around all manner of unlawful EOs and we really only have courts to play defense on them.

Slow down on the celebration. The 9th is less a court and more a Progressive indoctrination camp. They are less concerned with being judges and more concerned with being the enforcement arm of the leftist legislatures.

So the bill of rights only exists when it’s convenient. Sort of like unwarranted gun seizures during Katrina. If you only have a right when things are going well, you don’t have that right.

So theoretically how do they fix that? Should condgress pass a law limiting EO power? But then the executive would never sign it. You’d need a Rand Paul type president to sign that.

The reason I ask is because the media is portraying Trump as a dictator. That’s a little silly given everything he’s done so far is something other presidents have done before him. But he could be a dictator if he chooses, pretty darned easily. But so could Obama… where was the press then?

True, I like Presidents who try to get things done that are productive. I don’t like Presidents who tell me “you didn’t build that someone else did it for you”. Funny after working 10 to 12 hours a day 6 days a week for years and years I thought I built it.

I also don’t like Presidents who punish success with oppressive taxes. Then taking the money and expanding food stamp programs. And of course adding thousands of new IRS agents.

But in all fairness he did do something for employment. His wife had 22 personal servants at her immediate disposal. Nice.

Yes, Trump is goofy tweeting and talking about the Apprentice. He’s also a big mouth bragger and many other undesirable things as a human being…no question. But I will take him any day over Hillary and Barack. One proved he couldn’t do the job and the other proved to be a horrible Secretary of State.

Maybe Trump will be a disaster…then again maybe he will turn this mess around. Let’s wait and see.
