This is why Trump’s assessment is not quite correct. It was about ensuring the citizenship of freed slaves.
Is that a good thing, because if it is, then why does Trump want to end it? It did benefit most first generation Americans.
Yes. It would make no sense to tell former slaves they couldn’t be citizens but their children could. And ending slavery meant that no one, not even the children of slaves (technically former slaves), could be slaves. Citizenship was not necessary for them to not be slaves.
It would benefit them by default, because if you were a slave you weren’t a citizen.
If you became a citizen, through what ever means, you would be first generation.
So, not necessarily my views, but the approach I see being applied to birthright citizenship is to point out that it is an archaic redundancy, a product of slavery.
No slavery- no need to guarantee birthright citizenship.

The common sense stance is if you are born in the USA of an illegal alien, you are also an illegal alien, though still a citizen of the country of the mother. Everyone still is a citizen of a country.
This is the right answer, as far as I know.

“Student Visa”, no.
The simple condition is whether the mother is in the USA legally, or not. I would also like that the mother is here legally AND attempting to gain USA citizenship. I would be against those here on work or student visas.
But the common sense is a hard, fast rule, that if the mother is here illegally, that child is also illegally here. Very simple black and white line.
So, you would be ok with creating an underclass of U.S born kids? Stopping illegal immigration entirely will never happen.
I would like a hard line on illegal aliens. When officials find them, they deport them. It was like that in the 1970’s. I live in the port city of Jacksonville, FL. When Customs got wind that some were on boats, they would be out rounding them up, as many as they could.
We don’t need to stop illegal immigration. Just make their time here extremely in question. No peace. Once we get compassionate, illegal immigration is just a small inconvenience to the illegal aliens. And here we are today. Everyone is saying, “Stopping illegal immigration entirely will never happen.”
Millions were still in the U.S illegally.
Ports are much easier. They are controlled entry points. That is not happening on land.

All children born of illegal aliens should also be illegal aliens. All illegal aliens should be deported. If it sounds harsh. So be it.
IMO, the illegal alien mother broke two laws giving birth to another illegal alien. Her being here herself, and her “smuggling” in an unborn child, who is illegal as soon as the child is born.
It is very simple common sense. Unless you believe illegal immigration is okay, and we should turn a blind eye.
This is one of those things where I disagree with Trump. The language of the 14th is very clear. I would completely support a Constitutional Amendment to change birthright citizenship, though.
As I read the 14th Amendment it is anything but clear. Read “AND subject to the jurisdiction thereof.”
The only way to see that as clear is to believe all persons within the borders of the USA are “subject to the jurisdiction thereof.” If that is tge case the phrase wasn’t at all necessary.
So, we ask who within our borders is not subject to the jurisdiction. I wonder if all illegal aliens have the right to function within the jurisdiction of this country.
I try interpreting the Constitution as I believe the originators intended when they wrote it. I find it highly unlikely that the framers of the 14th Amendment had any intention of this amendment being an avenue for illegal aliens to acquire citizenship for their children. I find it difficult to believe anyone believes the framers would accept the current interpretation as anything they intended it be used in such a fashion.
But I do believe that there are plenty of lawyers who would look for a loop hole that the framers had not considered. One of the reasons I am so fond of lawyers.

So you don’t think the federal government has any right to exercise authority over illegal aliens or their children born in the US?
So, hospitals should check immigration status during childbirth now? How would that be done? What about kids born to legal long-term visa holders would they be second class citizens for years?
Even if you made that change it wouldn’t stop illegal immigration. It would just drive people underground and create a second class of undocumented kids.
It sounds simple and like common sense but, it is far from it.
My point is that the sentence of Section 1 of the 14th Amendment is as clear as mud. Let’s examine “All persons born or naturalized in the United States.” You cannot be naturalized if you are illegally here*. Why also shouldn’t those born here be born of a mother here legally?
