I seriously doubt he had the ability to do anything if the those two decided to rush him. Did you see the lame ass way he was holding his letter opener, if he didnt have surprise on his side he would of gotten his sword shoved right back up his ass.
I also seriously question the sanity or intelligence of anyone who carries a outdated weapon around. On that note he is lucky he didnt have to use that sword, or he would be in for more of a legal ass rape in court than he is already likely to get.
Courts generally have a dis-favorable view of using blades for self defense, a knife or sword is generally viewed by the court as something that someone would have to go out of there way in order to use as a weapon and unlikely to be used for self defense, while a gun on the other hand is seen as a much more convenient and reasonable means of self defense.
Thing is, that sword was probably just a cheap knock-off wall hanger that would break if he actually tried to use it. And even if it wasn’t, there’s definitely not enough room in a subway to use it.
… but it still made me laugh.

Looks to be NYC, where they put rape victims in prison for shooting rapists with an “illegal” hand gun.
Pretty sure a sword is legal in NYC, provided it’s not concealed (e.g., a cane sword) or actually drawn and “menacing” someone.
JB, how do you think a concerned citizen slashing into a couple of assailants attacking an unknown fellow on a train or subway would play out afterward? I know there are too many factors to say with any certainty, but could this guy have sliced through those guys and found a legal leg to stand on?

1: Do you know the guy? There are places where you can learn to use swords and he may have brought it to a class for show

Its not a long samurai sword, looks more like the personal defense one you use when the enemy is close. Last time I checked they are sharp as hell.

Its in phoenix I think. Pretty sure swords that aren’t concealed are legal in many states though.

Im fairly certain the the Transit authority wouldn’t be pleased if i decided to bring my rifle to the shooting range via public transportation. A weapon is a weapon no matter how ridiculous it is.
I would laugh like a motherfucker if someone telegraphs what there about to do, that idiotic traditional martial arts stuff doesn’t work in the real world. Boxing and BJJ on the other hand only give you the tools to know what you need to do, if you don’t have the common sense not to advertise what your about to do they wont do you much good.
Rushing would be irrelevant this is 2012, guns have been invented. A gun doesn’t require you to be up close to someone. But since you did mention rushing it would be a decent gamble if that guy has a lick of since he would realize swinging a sword around on a train means he has a fairly good chance at hitting a bystander. Besides that fight or flight often doesn’t take into account rationality, people often do very stupid things once there adrenaline kicks in.

In order to be justified, the actor must reasonably believe that the assailants are using or about to use DEADLY force. In this scenario the sword-wielder would probably be screwed.
Why do you assume he will be slashing that sword around? I am pretty sure if he was to use it, he would do a few quick stabs and then move to the next opponent. In the blink of an eye you could do a forward thrust into someones heart with a blade that long.
