They took all my stuff and sold it

Right. SM, you should try and see if you can track down the sentimental stuff. I suspect they sold it in one lot to the highest offer.

And see a lawyer right now. I don’t know anything about Aussie law. I’d offer to help more, but I’d just be guessing and you need to know exactly what your rights are.
Another fucking lawyer? Always with the lawyers. Thousands and thousands of dollars. I’ve spent a lot on lawyers recently and I’m not too keen to shell out at this stage. I’ll look into myself and see how much of his work I can do for him and make sure I’ve got something first and so on.
Sorry. Just trying to help. Most people who come to me for help are generally glad they did. For the most part I will tell people their basic rights up front and if they have any chance at a legal remedy. I will almost always do that for free and if I can’t help further I generally don’t charge them anything. If the issue isn’t in my wheelhouse I’ll send them to someone else; again, for free.

Good luck, I genuinely hope it works out for you.

No offense taken, none whatsoever. I just wish I could help more.

Sorry to hear about your stuff SM. That would really suck. Was your locker auctioned off or just sold to someone? There must be a way to track it down. As much as you don’t want to get a lawyer in this case I think you’d be crazy not to.

Man that sucks - sorry.

I think that is basically the business model. A percentage of people using storage are going through something rough and they hope it gets ‘rougher’.

And I hate that fucking show Storage Wars - fuck those people.

Thanks everyone. The terms and conditions say if your account is “outstanding” for 40 days and you don’t respond or they can’t reach you then they just sell all your stuff. I think the reason they sell it all is because they take the storage locker back so there’s no where to keep unsold stuff. Anyway, I need to look into if/how I did get into arrears and if I have any legal recourse here.
Here’s hoping that you do have legal recourse and that you end up fucking these people harder than they did you. Really sorry to hear this.

Yes the locker(a garage really) was either sold or auctioned to someone else. The guy at store said something about someone having their “eye on it” which I thought was strange. When he said “it” I wasn’t sure if he meant my stuff or the locker itself. There’s definitely something odd going on with this company.

Thanks man.

hard to believe they sold hundreds of thousands of dollars worth of stuff while claiming a debt of a few hundred dollars.

you make really excellent, thoughtful and intelligent posts here which makes me feel even more sympathetic about your plight.

i hope this whole thing is resolved as best as can be.

You need to report these guys before the next poor sod cops this in the neck.

They didn’t establish a debt.
They didn’t establish abandoned goods.

You simply can’t do what they did to you. Talk to the police. It’s the fastest and cheapest way to sort it.

When you take this to a civil trial, the guys being investigated adds weight to your claim.

This is a really big nationwide company. I think they’ve just taken advantage of very shitty terms and conditions. But that’s just my guess at the moment. I’m going to investigate every aspect of this and get to the bottom. Regarding the police, they’re always extremely reluctant to investigate consumer affairs type matters and they will definitely not look into something like this. They will just direct me to consumer affairs. However if there is anything criminal going on and I have evidence of it and present it to the police then they will act. I need to establish the facts first - terms and conditions of the rental agreement, consumer law etc.

Thanks for all the kind words everyone. I didn’t expect such an outpouring of sympathy. I think it’s important to keep things in perspective and realise that much worse things could happen. Many people are dealing with much more serious things like our recently departed friend doc. It’s a big bummer lose a library collected over several generations and family heirlooms and antiques, but I’m getting to the age where personal possessions are not as important as they once were. The most important thing is your health and your loved ones. Having said that, I’m going to get these bastards one way or another. This was a predatory move by the company. Someone “had an eye on” my locker. The way he said that was so dodgey. I think he meant someone had an eye on my stuff.

This whole thing sucks. I personally think that you should still call the cops instead of assuming they will push it off. What’s the harm in giving it a chance? If I had all my important worldly possessions taken like this I would jump at any chance to gut whoever did it to me.

Storage units are NOT for rare books, paintings, and works of art. They need to be temp and humidity-controlled. You seem like an intelligent man, so I’m surprised at your choice to store them as such.

You mention you can’t remember everything you had. In that case, it was as if they were already gone.

If it’s a lost cause retrieving your items or receiving justice, I hope you find peace with it, and that you gained some knowledge and strength with which to go forward.

You need to:

a) Ask the local police to visit, to understand the debt (if you cannot find out).

b) Liaise with a lawyer to confirm they have broken state law.

c) Get said lawyer to send the company a letter advising of such.

d) Go to civil court with a cost to everything.

e) Win

f) Done.

Given this site predominately rests with US users, you’ll find a lot more accurate (other than the Aussie poster) advice contacting both parties above.

And given the time length in which they have sold (or are in the middle of); you need to get the names of people, where they are storing your unsold stuff.

Yeah, I know what you mean but I know enough about the law to know the police will not get involved in a civil/consumer matter.
