I do believe that congress has the right to levy taxes per the . .uh . . constitution

Article 1, Section 8 of the US Constitution, which states:

“The Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States; but all duties, imposts and excises shall be uniform throughout the United States”

So what was your actual question?

that does not mean they they can tax whatever way they want in violation of other limits on their power.

Taxes are a form of regulation. I contend that vice taxes are a regulation religious practice and violate the 1st amendment. What aren’t you getting?
