Remember that Leasing Problem my GF Had?

Well, she had to pay another month’s rent even though she didn’t need to live there.
The move out date is July 27th.

We go today to move her stuff out and clean up. We walk in and guess what? There’s nothing there.

All her furniture is gone:
Full Size bed
couch
dresser
desk
kitchen table and chairs
coffee tables

WTF :pissed:

She calls the business office to find out WTF the deal is.

They said her roommate handed in both sets of keys a week ago, and that anything left after keys are turned in, is property of the apartment complex, which they TOSSED all her stuff.

That’s funny, if her roommate turned in all keys, how the hell did we get into the apartment? Yeah, my GF never turned in her keys. Her parents called and talked to the regional manager, but we have to wait till Monday for any resolution to begin as it was 5pm today when we got there.

Unbelievable!

Small claims court.

That sucks. If she still had her keys, you stand a good chance of getting some money from the owners, though.

It is illegal in all states to immediately claim property that is left in a residence immediately like that. Now some states they owners can move your shit to the curb but most are required to store it for a certain length of time before they can sell/throw it.

Seriously, if that furniture was even in halfway decent condition they showed a major lapse in judgement thinking that you didn’t want it without verbal confirmation. Did her roommate tell them she didn’t want it?

Your main problem is going to be proving what you had and its value.

Fixed.

Ha! Good one. I think that bed they threw out was a tempurpedic. Top of the line.

If you can get away with this, then go for it. They deserve it.

That’s bullshit that they did this though. Do you have any of the receipts for any of the stuff they threw out?

Bush’s foreign policy is to blame. I’d still stick it in her pooper.

You can definitely make a case in small claims court

unless of course its in the lease agreement.

if the room mate turned the keys in there was an implied agreement between them that anything left in there was unwanted, otherwise the keys would’nt be handed in.

they are required to hang onto to the stuff if they are kicked out.but even at that most all places I know of will say we can do anything and everything in our power to recoup the losses in rent, which included selling the stuff inside.

I think the room mate is the one that should be sued here they are the moron that was left in physical control of the contents.
even at that I think shes screwed because she shouldnt have left all her stuff behind if she knew she wasnt going to live there.

I agree this situation is BS and she should go over knocking some heads but she may not have a legal leg to stand on depending on what was signed or agreed on by the room mate

the roommate said she only turned one set of keys and the office said she turned in both sets but my gf still has her set. The office even had a list of what they tossed. The whole apartment was furnished with my gf’s stuff except the roommates bedroom. Didn’t they think hmm maybe we should call one of them

Her roommate got a letter/bill today for cleanup of the furniture $160 LMAO, yeah ok

The level of bullshit of this whole situation is through the roof in my opinion. I hope you tear some new assholes in court.
