Actually the case should have been frivolous, The product is assumed to be hot, 7 seconds? it takes me half a second to realize holy shit it is hot I don’t want it on me the lady deserved everything she got, I have been burned and you do not require skin grafting most likly she did this simply to get more simpathy to win her case. Also why didn’t she sue the auto maker for not having cup holders?

So she made up the skin grafts just to get sympathy? Yeah, that would explain the graphic photos of her injuries that were shown to the jury.
Two points here:

  1. She did not sue for the extreme amount of money that she was originally awarded, she only wanted her medical expenses.
  2. Remember a Jury of 12 normal people, none of whom had met before, came to their conclusion after hearing all of the facts.

Agree or disagree with the outcome, this case was not frivolous.

It didnt say 7 seconds, it said TWO to seven seconds. You said it takes you half a second to realize its hot, so if you can stop a car (while sitting in the passenger seat no less,) unbuckle your seat belt, get out, AND brush off all the excess coffee in 1.5 seconds, AT THE AGE OF 79, then thats pretty impressive.

Selling something meant for human consumption (the coffee) in a condition that makes it impossible to consume and is likely to injure is beyond retarded. I find it absolutely incomprehensible as to WHY they would make the coffee so damn hot.

FYI, here is a link regarding the other reported cases.

I agree that some level of tort reform is needed, but we need to look deeper into a case before passing judgement. Media outlets sensationalize and in some cases blatantly lie about the facts, Boston Barrister proved this during a discussion of a case involving withdrawal of consent in a sexual assault case.
In any case, individuals need to take responsibility for themselves and stop driving up costs for legitimate business and doctors who are acting responsibly.
