Man Arrested for Being Naked in his Own Home

I’m just reading from the statute that includes the words “in any place where others are present”. Obviously there would have to be a breach of privacy by the police officer in order to arrest someone in their home on the grounds of indecent exposure.
Virginia law still includes “Fornication” as a criminal offense and obviously this indecent exposure law is equally as ridiculous.

So, looking into someone’s window isn’t a crime? He was alone in his house, no one else was present. A woman looking in his window is not “in the presence of others.” He should seriously press charges. Or hopefully the judge will throw out the case.

On the outside this seems like a funny story but if the court is crazy enough to prosecute this man something is terribly terribly wrong. This man’s American liberties have been grossly neglected.

So does this mean if I am out at a mall and a women takes out her boob to feed her baby that I can call the cops and have her arrested and put on a list?

if the cop walked by and saw the crime then that gives him reasonable right to make an arrest. much the same as when your having a party and you open the door with a dutch in your hand to welcome a cop. in your house or not if the “crime” in question is witnessed by the cop he will make the arrest. that said even if the cop had not witnessed the crime i doubt the man would have known to assert his rights when the police asked to enter his house.

“im sorry sir, but i do not consent to any searches.” a phrase that would keep LOTS of men and women out of prison. its no wonder they dont teach it in the schools…

Many states including Virginia have written in breast feeding as an exception to their indecent exposure statutes. I suppose it depends what state you’re in.

I have no disagreement with you here. I was just clarifying what is currently legal precedent for reasonable suspicion of a rime being committed. A crime reported over the phone by a second party and a crime reported by a second party where the accused has an expectation of privacy(i.e. his own home) cannot be used to qualify reasonable suspicion. If the police officer makes the discovery first hand, then reasonable suspicion is in effect as you correctly pointed out.
