This is truly disturbing. Isn’t a reasonable expectation of privacy an established legal concept? Applying the same reasoning, couldn’t someone bring charges of indecent exposure against you if they observed you urinating in a public restroom? Or, if they peep through your bedroom window and see you having sex, can you be arrested for lewd behavior and public indecency? How about if they have to drill a small hole through a wall to see? I mean, if privacy no longer exists, how far can you take this?
You also have to wonder why the cops arrested this man. Just because the woman calls them and signs a complaint doesn’t mean they have to follow through if they determine no crime has been committed! Otherwise, if someone witnesses you swat a mosquito and calls the police to report a murder - are the cops obligated to arrest you, and then wait for a judge to sort out whether the charge is legit? (Just think, PETA could have all stock yard operators arrested as serial killers!)
I hope this guy sues the woman for harassment and sues the cops for false arrest.

I agree that this is pretty fucked up, but nowhere in that article does it say that the woman was walking through his property…
Reread the op’s CAPITALIZED portion. Also listen more carefully to the video link. It clearly states that the woman cut through his property.
I obviously read the OP’s capitalized portion, which is why I made the statement that the article doesn’t mention it. I thought that would be obvious, but maybe you didn’t pass your SOL? And the video link wasn’t working when I posted, so the article was all I had to go by. I can’t help that the shitty journalist didn’t think something like tresspassing was worthy enough to include in the write-up. Maybe they didn’t pass their SOL either?

I think they have their hands tied behind their back in that scenario.
This isn’t true in the slightest. The cops are forced to INVESTIGATE at that point, but not arrest.
If the guy does get found guilty by the caught it is very likely that he will now be on one of those lists of sex offenders. (That may not be the right word, you know the lists i mean). unable to live in a certain distance of schools, getting harrassed by “Protect the children” groups, Required to notify police if he moves house…

There is something seriously wrong if someone like that is not laughed out off the police station.

Holy shit…
I totally agree with you. ![]()

This whole situation just needs this.

Not to mention losing custody of his children.

that woman is an idiot. any reasonable judge will throw this out.
Any reasonable cop shouldnt of arrested him.
I don’t know if this is true so anyone feel free to enlighten me. I know that where I live if you get caught taking a piss outside and arrested and convicted, you have to register with the sex offender people. Will this guy if convicted have to register as well?
I walk around my house naked maybe I’m to small to see? Wait!
No, but seriously this is dumb. Here is something as dumb:
A freind of mine and a friend of his were playing bball in the college gym. The ball got away and went into the girls change room. Now his friend stood outside the door yelling if anyone was in there and would pass his ball back out. So after a couple minutes of that he thought no one was in there went in a lo and behold a girl was there in a towel. So long story short he got expelled for 4 years. That is ANY college. He just recently got back into school for some stupid incident that favored the females side.
On a similar note those two guys were showering and a women vball tourney was taking place and they needed a place to change. So they went in the guys change room and they walked in on them showering and gave them the whole “Up and down” look. To no avail they didn’t even get a slap on the wrist when the guys reported that.
FUCK WOMEN and their gay antics!

I am just imagining going to an Austrian cop and complaining that I saw a naked man in his own home while trespassing on his property.
That might leads to some interesting reactions, to say the least.
The woman broke no law by being on his property without a warning.
However, the police could not have entered the man’s home without his consent. The observation by a second party of a crime being committed inside the home of a third party does not constitute reasonable suspicion because the third party has an expectation of privacy inside his home.
It’s similar to that man being arrested for disturbing the peace on his own property after the police had gained entry into his house based on a phone conversation.

Since when is being naked in your own home a crime? Since when is getting coffee at 5:30am a crime? I cannot believe you are actually defending this woman. You need to be sterilized so you don’t pass on your stupidity to the next generation.
I’m always naked around my place.
In fact, I put on puppet shows for the neighbors.
I do this shit all the time, when I heard this it freaked me out.I live in a condo on a busy street and my kitchen window is right on the sidewalk, I go in my kitchen naked all the time.

Like those two guys who used to do the penis shows and fold their junk into different shapes, like a hamburger?

Sadly, no.
It’s sock puppets.

Calm down. I’m not defending the woman I’m just saying that there isn’t any criminal law in Virginia that makes what she did illegal.
I’m just reading from the statute that includes the words “in any place where others are present”. Obviously there would have to be a breach of privacy by the police officer in order to arrest someone in their home on the grounds of indecent exposure.
Virginia law still includes “Fornication” as a criminal offense and obviously this indecent exposure law is equally as ridiculous.
Here’s the link to the statute.

I was kicked off the girls gymnastics team in grade 8 for going into the boys change room. ![]()
This was after a guy grabbed my gym bag and ran in there, so I said fuck you and went in after it. At the moment I was prying it out of his hands, in walks coach :-\ He was unpunished.
