But in that case, you’re just making the parent who already wasn’t going to win primary guardianship in Texas even less qualified, lol. My point was that being female-born will generally trump mental health as a qualifier for primary guardianship in Texas. So saying ‘the sane person gets the kid’ just isn’t so here.
It is tough to draw this line without making women second class citizens with fewer rights.

Yes, and they are permitted to (at least in Texas, I don’t know if all states are the same on this), but this is a VERY interesting question that’s been largely ignored. Abortion can (and will) be made illegal following this supreme court decision when it becomes effective in a lot of states, but what do you do about things like this? Do the rules change by trimester, as the ‘science’ of pregnancy changes? How in the fuck do you enforce it? really interesting.
Same here. I was more of a dog person lol. Didn’t really give a shit about kids before I had my own (2 boys).
Now I can’t even listen whenever something bad happens to a kid, even in movies.
I really don’t get how some people have kids of their own and show no empathy towards other people’s kids.

Under current law, rightfully so IMO. The difference between this and the drinking example is that the suspect did something he didn’t have the right to do to either of them. I believe currently it would be seen that the woman has the right to drink regardless of what happens to the child, because she controls consent of the child while it is inside of her.

I believe if we do a thorough investigation we will find that no state (or very few) prohibit a pregnant woman from drinking alcohol in excess.
But in Florida if the baby is born with birth defects and the delivery doctors believe that the mother carried that baby under the heavy influence of drugs and/or alcohol, they will contact the Department of Children and Families and the parents could very likely lose custody of their baby to the State. And then the rest of us will contribute to the raising the child.
I speak this from experience. My twin boys were taken from their parents in the hospital and given to a foster home. We began adoption procedures three months later. They both have learning disabilities.
I’m really not trying to be edgy or sarcastic. This type of talk doesn’t register to me. To me, there are no “accidents” and “unexpected pregnancies”. Aside from rape, people have sex by their own volition. And babies come from sex. So how is the result “unexpected”?

But you do understand that not every sexual intercourse is done with the intention of breeding.
You also understand that no contraception is 100% effective.
