Gun Control III

Obviously the phone!

Dooood, if you expect criminal breaking into your house to follow the law…

It’s a known fact that 94% of home invasion suspects legally have a permit to carry.

This is common knowledge in the law enforcement community.
/sarcasm.

Like I said, it sounds like that community needs more police officers.

LOL…on a serious note, it’s also common knowledge in the law enforcement community that law-abiding citizens aren’t often victims of home invasions. There is just no way to justify private gun ownership except, ultimately, as a means of defense against public guns.

You forgot the /sarcasm on that.

Then why do all the cops I know encourage people to get CCW permits?

I hope for the same reason I gave, but I would say that because they spend 95% of their time at work dealing with the bottom 1 or 2% of society, they have fallen into the trap of believing that those they deal with at work are representative of society. They are likely also genuinely decent people that understand being armed is both preferable to and safer than being unarmed. Personally, I would prefer to see a greater number of people start open carrying.

Great quote Push, incredible the wisdom and vision the Founding Fathers had.

Yes, although, in truth, firearms stand above the Constitution in importance. That’s why those who are in favor of firearms regulations are idiots, unless they are either in charge(exempt) or in favor of losing all rights(wannabe slaves). The Constitution is totally meaningless without firearms.

I ask sir, what is the militia? It is the whole people except for a few politicians. - George Mason (father of the Bill of Rights and The Virginia Declaration of Rights)
On a related note, most people do not realize that nearly every able-bodied American male is a member of the US Militia. So if I ever come across a gun-control acolyte who wants to know what militia I am a member of, I can answer the question accurately.

Of course, this sort of validates the thoroughly-debunked notion that the right of firearms ownership is connected with service in a militia, but it is still a fun curve ball to toss out to people who assume that militias no longer exist or that one must be in a militia to have firearms.

U.S. Code > Title 10 > Subtitle A > Part I > Chapter 13 > § 311

(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.

(b) The classes of the militia are –

(1) the organized militia, which consists of the National Guard and the Naval Militia; and

(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.

So by this definition, felons falling between those ages are also technically members of the Militia. And therefore any laws restricting the rights of felons to own firearms are unconstitutional.

I am using the term “felon” loosely, because anyone who is ARRESTED for domestic dispute, etc… ALSO loses their second amendment rights. It all seems pretty unconstitutional to me.

Easy to defeat–Fire extinguishers do not create fire when used. Guns do shoot bullets when fired. You will have to try harder to justify private firearm ownership.
The point was, when you need to put a fire out a fire extinguisher can be feet away while a firefighter will likely be miles away. Replace fire with rapist, fire extinguisher with gun, and fire fighter with police officer.

Misuse of a fire extinguisher can result in death too.

Nope, doesn’t work that way.

This US Code is totally unconnected with the 2nd Amendment. It simply details the composition and classes of the US Militia.

DC v. Heller cemented this lack of connection. The first three pages on this link will explain it better than I can.

Besides, who says you need a firearm to be in the militia? Only in the Marines is every soldier a rifleman!

Without a doubt…probably why that issue was dealt with almost 200 years after the second amendment was written. Gun Control Act of 1968 - Wikipedia

Of course, many felons who now have a chance to be released would likely have been quickly put to death at one point in time.
