The court wasn’t ruling on whether what he said was right or wrong, but rather whether the Board of Medicine had the power to reprimand him for how he delivered the message.

“While the Court does not in any way condone the type of comments made by the petitioner, it is nonetheless important, as a general matter, to ensure that physicians and patients are free to discuss matters relating to health without fear of government reprisal, even if such discussions may sometimes be harsh, rude or offensive to the listener, Fitzgerald wrote.”

I don’t think that this woman has any case at all, and should’t be allowed to stand before court with this. But the McD’s coffee woman suffered third degree burns on both thighs from their coffee. I guess I’m in the minority that thinks you shouldn’t be selling a beverage that’s so hot it’s disfiguring.
