12/4 ironless lifting
4 days’ accrued moving law partner’s family from sold house into fantastic rental, w/o yet touching furniture. Wife collects giant flower pots. About 10 days’ work to go. He out sweats me but thankfully he’s hiring a piano mover for the piano, I’m tethered to the rest. He’s hired an architect and is building a new house so I get to do it again in about 8 months.
I finally convinced him to remain in the partnership and to reject his 2 great job offers. I told him he’s far too aggressive to downshift to work for bureaucrat/committee lawyers who fear jury trials, and that the lawyers he was competing with for those jobs would certainly kill for his practice. Seems he had been letting me take out significantly more money than him for last 8 months, and he compounded it by refusing to complain. That’s now fixed.
My reward is I’m learning new/interesting swear words from a 48 year old’s perspective. However, if he keeps referring to his new landlord with “suck my…” , I’m gonna say something to change that attitude. Landlord constantly negotiates over lightbulbs (about 100 burned out ones)., a vessel sink’s push plunger drain stuck in down position, etc. Still combing youtube for the drain solution. Anyway, forearms and back are getting good workout.
I’m helping him because I want him to have the best possible lawyer and family life experience, which my practice has provided me over the years. I shouldn’t write this, but I regard him as the son I didn’t have.

Crazy weather and times you are having. Do you do criminal defense or some other area of the law? BTW some of my best friends have gone to the “darkside” of criminal defense, so it’s all good.

Since you asked… First, to be absolutely clear I fully support all law enforcement; they keep my family safe. ( had a home invasion by heavily drugged woman who broke my nose when I got her out of house.)
I had no clout to ever get a job as an assistant DA …and DA job never paid enough to run for it. Was part time indigent/public defender for 23 years to pay the bills in very small town. In a fair sized suburb town now, I get about one criminal case every two years; law partner does about 2 a month and they’re drug or DWIs.
Best one was my 5 year defense of an Angola inmate from upstate New York serving 3 life sentences for murder when he attempted to escape. He and 5 other inmates evicerated a guard during escape. Guard bled out; remarkable blood pooling photos and absolutely worst case I ever defended. State appointment with truly unlimited funds for defense, and cocounsel and I spent intelligently and with abandon. Client was convicted of capital murder as part of a conspiracy, scant evidence he did the killing. Second half of trial was for life or death sentence, and our mediation experts produced sufficient witnesses from upstate New York and around the country who all testified by Skype; we got one of the 12 jurors to steadfastly vote for life. Judge singlehandedly worked his ass off trying to convince jurors to reach unanimous decision (i.e. death) in the several times the jury returned for more instruction. He failed, and the prison furnished all meals to jury during deliberation!!! Client now spends 23 hrs a day in a cell.
During representation we had atty representing a co derfendant die from heroin overdose. We had a very smooth assistant DA from New Orleans be disbarred for having child porn on his office computer. Two others who replaced him had reputation for being a statewide “death squad”. One of them lectured extensively at DA seminars. I will never forget all the Angola people crowded around those two outside the courtroom as I was leaving the night of the jury’s life verdict–looked like a lynch mob–the two assistant DAs in the center of it looked worried. Probably was new experience for them. My cocounsel and I later learned those two had intentionally hid important eyewitness evidence in our case from us. The evidence surfaced in one of the other 4’s trials, and cocounsel got those two guys in serious trouble with the state’s disciplinary board. They were then fired from their DA jobs. Saw one a few years’ later and he couldn’t have been friendlier.
Civil practice is nowhere nearly as exiciting, but less lynch mob mentality.
Just wondering. One of my best friends was a deputy prosecutor for several years. As is the case in most areas he did not make any money. He moved over to defense. We give him crap all the time.
My other friend is one of our biggest personal injury lawyers in the area. Civil practice may not be exciting, but he makes tons of money. He’s one of those guys who has commercials on all day long.
In 22 years I have testified in murder trials all the way down to traffic tickets. I have was lead investigator on one of our most famous murders. I was the supervisor on many more. I can honestly say I have only had one really bad experience on the stand. This guy, my neighbor, accused me of lying and everything else to get his client off. I called him out on it afterward (since we know each other from the neighborhood association). He told me he was just doing his job, and it was nothing personal. I explained I would never risk my job, car, house, and retirement for a car thief or anyone else. He just looked dumbfounded.
Most of the older defense counsels the area I know personally and can have great conversations with. We have mutual respect I guess. The funny part is my neighbor’s truck got stolen a few months later. They caught the guy, and he was a former client. What comes around I guess.

Crippler, usually guys use DA office as stepping stone to a judgeship. Better background than defending child rapists. And tons of money is perennially exciting.
I testified in one of law partner’s cases recently. Opposing counsel, questionable credibility and trust fund junkie, accused me of lying. He was in office 30 seconds about 3 weeks later; paralegal kept me in storeroom for his visit. I’m not a brawler, and I have a really high boiling point, but I remain cold mad about that. I’m gonna break something on his body, somewhere where there aren’t witnesses.
Only problem with “what goes around…” is that one doesn’t always get to see it “come around” when it inevitably does.
12/12 yesterday’s pm workout
Around 10 am I learned friend with truck bailed which prevented Sunday moving, so I spent 6 hours yesterday pm catching up. Law partner at cardiologist’s in am; ho ho. Yearly checkup. Professional movers in pm moved piano–I won’t move pianos–and also moved sofa bed/beds/entertainment center/tvs up 22 steps to second floor bedrooms. My counting steps was probably a bad idea; I now know each one intimately.
When I first got there his father in law and a friend–truly nursing home escapees-- were moving single rather small boxes with a dolly. Jeez. I was thanked profusely when I left last evening. They were spending last night in the rental; today last few bits, and their house sells Thursday. Bottle of exceptional champagne in office fridge to celebrate.
A 30 something mover told me they do this daily…excepting Sunday, so do I.
12/14 finally finished moving. Sore almost everywhere this morning. Odd. No soreness over last 3 weeks/last few years.
I learned I’m 14 months younger than the two “escapees from nursing home”, law partner’s inlaws, who helped move the last few days. Neither could lift over 10 pounds and each took half steps everywhere. Various medical conditions dictated their restrictive diet choices at lunch. But for the grace of God…
