I think you are referring to textualism versus originalism. There are nuances of each. Most judges and attorneys will be pluralists combining all or multiple of the nuances depending on the issue.
Scalia espoused a conservative jurisprudence and ideology. He advocated textualism in statutory interpretation and originalism in constitutional interpretation.
If the Republicans can just nominate someone sane, they’ll be fine. Especially if Joe doesn’t get a new VP. It doesn’t have to be a RINO. Just someone sane.

That guy is going to be attacked the same way as Trump, and he’s either going to fold…or become Trump-like if he wants to stand a chance in the presidential election.
Well after digesting a few lawyer takes on the Trump indictment it sure seems like he fucked up. Whether that translates to jail time or simply another national embarrassment of an election remains to be seen. If it came down to Trump running in an orange jumpsuit and Joe Biden, I’m going to have to vote for Trump. I’m not throwing my vote away on Cornell West or some other independent.
I’m generally in favor of prosecuting powerful people who commit serious crimes, but the obviously troubling issue here is the double-standard. It is so glaring that it becomes obvious that the double-standard is the point. Not unlike how we’re told to accept the notion that men are women upon declaration, and that it is imperative to impart this information to children as young as K-3.
