I agree that this law is crazy. But Jared, I was kind of wondering what type of physical evidence of rape I can leave on my attacker if I’m passed out dead drunk or drugged?
punkin, then the issue will be proving that you were in that state and that something happened. But then, how would you know if you were raped? If you had proof that you were raped while comatose, then you would likely have proof of who did it.
But raping someone while they’re out is completely different than raping someone after they’ve started having sex with you and decide to back out, at least when it comes to proving it.
Most importantly, for women and men alike, is to be smart. Don’t drink until you pass out at a party. Also, there are ways to incredibly reduce the risk of you being drugged. I have little respect for those that put themselves in stupid predicaments, but I have much less respect (hatred!) for those that take advantage of such people.
Back in the days when a female’s hymen was intact until her wedding night (or she was stoned to death) it was fairly easy to determine if she’d been raped. There was absolutely zero motivation to do the deed willingly since she’d die if and when she married and her husband found himself not to be the first. There was absolutely zero motivation to lie and accuse someone of it when it hadn’t happened as it could easily be proven a lie. Those were the last days that you could take a female’s word for what happened as absolute truth.
Nowdays, it’s a matter of physical proof - or fucking ought to be since chicks fuck whoever and whenever they want and say whatever shit they want to say. I’ve been on pretty much every side of this situation and I feel those experiences give more than hypothetical weight to my views.
I don’t want to turn this into a maudlin outpouring of sympathy for rape victims and outrage as the assholes that do it, so save any condolences you may be tempted to post. The facts are simple and they are these:

I’ve been raped, forcefully, and had received, as well as left, plenty of “evidence”.

I’ve been raped, under intimidation, and received no more “evidence” than any session of rough sex and left zero “evidence” of rape on the bastard.

I’ve been drugged and that situation had every potential for rape - thank God my girlfriend stepped in and took me home.

I’ve had consensual sex and regretted it.

I’ve never pressed charges.
Why? Why not press charges? Well, the forceful rapes occured when I was a preteen and early teenager and I hadn’t my wits about me nor the relationship with any adult to be able to confide in them. I knew I could have nailed the bastards legally but I allowed the legal system (and the assholes) to intimidate me. I chalked it up to experience and moved on. Later, when I did have my wits about me, I arranged for justice. They got what was coming to them and I felt no need to involve the law at that point.
The intimadation rapes occured in my mid-teens. In some instances, they got justice. In others, I chalked it up to experience, accepted my role (being passive) and made the decision on what to do if there ever was a “next time”.
The being drugged thing happened less than a year ago. I was stupid and did what soo many girls do: I accepted a drink from a guy I’d been talking to/dancing with all night. He seemed harmless, funny, cute, decent head on his shoulders and a plan for what to do after college, liked to have fun, kind of a goofball. After the drink he gave me, my girfriend found me pinned against the wall by the exit of the bar and a different guy had his hands under my clothes groping me. I had a completely vacant stare in my eye and was not reacting to him in any fashion whatsoever. Luckily, she knew that is sooo not me and the guy was sooo not my type that something had to be going on. She tore him off me (literally, she had to punch him in the face) and took me home. I remember nothing of this. I was violently ill for the next three days. The next day, when my brain started functioning again, I knew I could in no way ID either the guy who gave me the drink or the one who had me against the wall. A sexual assault had occured, a rape had not (therefore no physical evidence). There was nothing that could have been done by going to the police.
So Punkin, to answer your question about being passed out drunk or drugged - If you are raped under these conditions there will be physical evidence. How do you prove it wasn’t consensual? Blood tests confirming presence of the drug (evident for up to 48 hours after injestion) and anecdotal evidence of being passed out drunk as well as the very high likelihood of vaginal tears. Most rapists don’t concern themselves with getting you turned on or bringing the KY. It would be vital in these circumstances to go directly to a hospital for a rape kit as soon as you are conscious. Failure to do so would slitting your own throat when it comes to pressing charges. And yes it’s true, just because you can prove you were raped doesn’t mean they’ll catch whoever did it. You have to use this fun thing called “Best Judgement” on that.
If a rape genuinely occurs, I think the bastard should get his - legally and otherwise.
There’s no excuse these days for intimidation rapes. Females are way too well educated and supported for calling rape to allow for genuine intimidation rapes to go unreported. Failure to report a genuine intimidation rape within 24 hours and comply with all the evidence gathering aspects is, in my humble opinion, making the female an accessory (after the fact) to the rape just as a witness to a murder who doesn’t report it is an accesssory. She forfeits her right to call it rape.
If a drugged rape occurs, same thing. Report that shit and comply with evidence gathering or shut the fuck up and deal with your bad choices.
If you begin consensual sex and change your mind mid-stroke, you better fucking make it clear beyond a reasonable doubt that continuing is rape. That would involve fighting back as violently as if you’d never consented in the first place. I can’t stand the “He said/She said” shit. What are the physical facts. They began consensual sex. They finished sex without so much as a scratch, bite or bitten off penis. That equals consensual sex start to finish, in my book.
If you have consensual sex, finish the act, then later regret it… Fucking suck it up as a bad choice YOU made…not a bad choice HE made. Take responsibility for your actions instead of blaming the shmoe for believing you.
There’s very few people on the planet I have a lower opinion of than chicks who falsely cry rape. I’m not above thinking their just reward would be to have a train pulled on them.
Excellent, ~karma~, but I do have a question. What would you consider an “intimidation rape”?
Jared: “Intimdation rape” would usually be the traditional date rape scenario where the guy pretty much uses psycological/emotional manipulation and intimidation to get a chick to fuck him.
The whole “I spent X on you and I deserve sex in return” stuff or things like “You know you want it. Just give it to me…I’ll take it hard or I’ll take it easy…Make it easy on yourself”. And in case you’re wondering, yes, those are almost direct quotes from the motherfuckers.
What starts out as kissing and heavy petting, gets to where clothes are coming off and the chick backs out but the guy starts to get rough and pins her down and says shit like that. Your choices are to give in to the intimidation and hope he gets himself off quickly and you get out of it with no black eyes or split lips - or fight like a motherfucker and possibly get the shit beat out of you and then raped on top of it.

That’s why I say there’s no real justification for intimidation rape nowdays since women are much stronger in their demand for equal and respectful treatment. They are very well educated on the consequences of crying rape without proof and science is advanced enough to back up (or invalidate) their claims. They KNOW it’ll be a “He said/She said” and her name will be mudd too because of all the little bitches out there crying rape falsely. That’s why you should fight back and risk getting the shit beat out of you. Not only is it going to be a rape charge but also assault and battery, and that’ll net the fucker more time than just rape, and of course, there’ll be no doubt whatsoever that it was rape.
The world is going to shit because of lawyers and bullshit laws like this.
I guess I probably would be in a penitentiary right now serving say about…13 counts of rape according to this law.
I can’t tell you the number of girls who changed their mind midstroke, only to change it back once I stop.
As long as you’re not forcing yourself on someone there is going to be a lot of grey area with this law.
So what happenns if they change their mind after it is over?
This law sounds real shitty.
