If the GOP controlled senate expanded it to 12 and subsequently gave a term 2 Trump 6 justices by fiat, we all know what the accusation would be.

If the GOP and Dems are so concerned about an additional judge, perhaps they should both look very hard at why they care so much. I think it would be far better in the long run to clip the USSC’s wings, rather than trying to stack it for short term advantages.

Both parties love using the bench to win battles that they can’t win at the ballot box.

I don’t see how to fix it. However, it’s been in there since the beginning. Anything the federal government isn’t given explicit permission to do is up to the states or the people.

“Regulate interstate commerce” didn’t mean “pass any regulations you want on anything that could conceivably become part of interstate commerce at some point.” It meant “ensure interstate commerce can run smoothly and without obstacles created by the states.”

I find this a bit different and more extreme. First, it is completely within the Presidents realm of power and normal expectation by his constituents to pick a nominee to fill a vacancy even late term. It’s both legal and not wholly unethical. It’s only when you bring in the “but he said she said” that you have any merit based argument which to me is weak.

Second to pack the court starts changes the landscape of the Supreme Court and opens it up for a revolving process when powers switch to what end? Will we one day have 100 justices?

I can agree to that. At the same time if you have the Senate and the president there isn’t anything stopping it from happening. The other side will cry foul while the other side goes on with it.

I’m really curious to find out what the nominee will be accused of. In fact, I’m more curious about this than who the nominee actually ends up being. You’d think “gang rapist” would be a tough accusation to top, but it is 2020.

What do our experts think our next SCOTUS nominee will be accused of?

Human trafficking?
Russian double-agent?
Dog fighting?

If I had to guess? They’ll be accused of Catholicism.

I am not Catholic, so I’ll leave this up to those who are.

But Barrett reportedly practices a form of Orthodox Catholicism that is out of the “mainstream”. She also has a paper trail on her feelings about abortion. (Note: She HAS said that she doubts the overturn of Roe v. Wade).

Again…discussing these topics is way out of my “heathen league”…so I’ll let others comment. But this will most likely be the type of things she will be questioned on. (IF she is Trump’s nominee).

(I do think it would be kind of funny if she was asked if she liked Beer…!)

Wouldn’t this just resemble the first (superior) form of the senate? What you lose on the swings, you gain on the roundabout, I suppose.

I always thought that polititians nominating judges for the supreme court is less than ideal as far as promoting the independence of the judiciary system.

It seems to me that these justice appointments is basically a part of the political battle between Republicans and Liberals.

Is there any other western country that does this? As far as I know in most developed countries SC nominations are done by senior members, which at least keeps political interference at bay.

At least that’s my understanding.

It has become increasingly political in the U.K., but that’s a result of us making a ‘Supreme Court.’ This August organisation is younger than I am, and it’s a constitutional abomination.

Irish appointments are a tad murky, but as the Irish amend the constitution once every calendar week, they have less opportunity to legislate from the bench with any lasting consequence.
