This is one debate for which there is practically unanimous and overwhelming historical representation of original intent so comprehensive that only a person of questionable honesty or utterly immune to evidence could disagree. Whatever anybody thinks of whether private citizens should own guns it is simply beyond credible dispute that the men who oversaw our founding thought they should. It’s like debating whether they believed Boston was a peninsula.
May I say hooray to this decision?
Scalia is a beast on the Constitution. One of the guys in my case challenged his sentence and the SCOTUS heard the case. SCOTUS overturned the original judicial decision, with Scalia having a concurred opinion based on concerns for stare decisis (basically, do not disturb the what has already ruled upon.)
This is a somewhat side, but related issue. Has anyone stopped to think what the court could have ended up looking like if McCain had won the election? A thing I harped on constantly during the campaign. It’s almost impossible for me to believe anyone he would have nominated could have been worse than these activist hacks we’re getting now.

hmmm, you know- they probably would have been true “moderates” and probably preferable to Obama’s picks - but remember, he still would have to get them through a democratic senate

Frankly, I don’t know if McCain would’ve chosen justices to my liking.
Bush II’s greatest legacy may end up being Alito and Roberts.

These are all fair points and I do believe some good is coming out of the kick in the constitutional nads the country is getting from this. McCain wasn’t to my liking though so I wasn’t expecting another Antonin Scalia from him, but it’s tough to believe he could have done worse than this and maybe much better. Even maybe by accident.
I’m gonna have to go dig my boxes of VHS tapes out of our garage. I’ve been reminded quite a bit lately of stuff I have on those tapes. Like every minute of the Thomas confirmation hearings on Cspan. That and the Robert Bork lynching should be seen by everybody who thinks the left are warm hearted humanitarians. I think Thomas got it worse though.
I think that everyone should be issued a handgun when they get their driver’s license.

Have you read his autobiography? Its really a great book, and covers that period in some good detail.

While I cringe to think what a McCain appointed Supreme Court might do, I don’t have to worry about it.
But this overturning of the gun ban is a wonderful, wonderful thing. The right to keep and bear arms is an essential one to the liberty of this, and all, countries.

Do you have any doubts as to how Butch Kagan, ostensibly someone you would not cringe at precisely because she is the nominee of your man, would have ruled on this?[/quote]
She wouldn’t have ruled how I wanted her to most likely. But gun control has been the lone issue that I’m “conservative” on… it would not be worth it to have guns but have students taught creationism, having sex ed banned in schools, and then getting back alley abortions when the court supported all of those things.
