I get on her case because she is an obviously biased judge who is about to be appointed to the one court in the land that should have no bias. Look at my avatar- Justitia is blind. Sotomayor is not.
Now, I’m not defending her comment, but I don’t understand why you (and others here) say she is an obviously biased judge. As far as I can tell her actual record of cases shows no real bias, and isn’t that what is important, how she’s actually judged? As far as I’ve heard of the nomination hearings even the republicans on the committee who really don’t want her in there even admit this. The best they can do is question whether, despite her unbiased record, she will show bias once she is on the high court.
In any event, it seems that all one can draw from her comments is that she has strong feelings about certain issues–but so does everyone. Her record demonstrates that she is not a biased judge.
Her mouth is what is hurting her more than anything. When she said that the 2nd Amendment was not a fundamental right, I nearly fell out of my chair. If you truly question why she might be viewed as biased, then you need to look at the situation from a neutral point of view.
I am overly critical of all supreme court nominees, as it is but another organ of our representative government whose members are neither voted into office nor accountable once they are there. Furthermore, her comment to the affect that circuit courts are where policy is made rubbed me the wrong way. Legislature=policy formation. Judiciary=legality of aforementioned policy.
There have been many groups (including the GOP) trying as hard as they can to find bias in her voting record; some “trend” that she has some racial/ethnic/sexual bias.
There is none.
Even when questioned about the New Haven Case (a decision that I thought was a bad one, and was more the fault of the City of New Haven as anyone); the feeling was that she was following judical precedent in the Case. (I let those with more understanding of the Law comment more on that).
Another thing you guys have to be careful of; (and this has tripped MANY people up)…thinking you know how someone will Vote on the Court because of the talking-heads you choose to listen to.

This might make me look bad, but i gotta speak on it. Obama also selected Regina Benjamin to be the next Surgeon General. A black female. Does anyone think Obama might be appointing these individuals based on the “historic” firsts so that he can cement his administration as one of many firsts? Or is it a coincidence that they are both female minorities? Not saying they aren’t qualified, just a thought.

Maybe you draw the wrong lesson from this. The lesson isn’t that Sotomayor should be hung for her comments, but that no white man should be hung for similar ones either.
To the best of my knowledge, no white man actually has said such comments. It was Sotomayor and Obama who even mentioned the issue of gender and ethnicity.
Of course. They’re both racists. He got his from Pastor Wright and she got hers growing up in the Projects.

Okay, I get that. So should we have an Hispanic judge for Hispanic cases?

And judges with a business degrees make better decisions on commerce clause cases, and people who have raised kids make better decisions on reproductive rights, and judges with a criminal record make better decisions on criminal cases, and so on and so on and so on…

It is the price we pay for having been the dominating force in the country for the last 300 years. It is, indeed, a small one for the shit that white males have done.
As I see it, we still are the dominating force in this country. I do not see how this statement said by a white male should ruin him politically? As I see it, until the Latina’s, as a whole, start worrying more about their knowledge and intelligence instead of having babies, her statement is true.

Yes but it’s the “good” kind of racism, or should I say “correct.”
Now had the same thing been stated except for being in the direction you had in your post, it would be unacceptable. Don’t you know anything about what is politically correct?

As I see it, that’s one of the most blatantly racist things I’ve ever read on this forum.

Because being wise has nothing to do with being Latin or female.

How is it racist, which part? Or just because I agree with her does it make me racist? She is a wise Latina is she not? So, what does that say about wise Latin’s if that is her opinion of them, especially with her experience.
